On december 22 2010 at around noon I went to Longs peak hondai looking to trade my 2002 chevy silverado 1500 z71 4x4 crew cab pickup in for a car. I met with a sales person and told him what I was looking for something with better gas mailage and a strait trade or very close he showed me a 2002 vw passat with close milage 136-138k miles for around $6800 and stated that that would pass as a strait trade he also showed me a black hondai accent I believe was a 2010 with around 2k miles that would have given me a low amount with trade less than $4k To test drive I was asked for my keys and they made a copy of my license no signatures where required.
we tested the vw and since it was all wheel drive I asked if I could test it on a dirt (prospect rd) since I knew it was a maintained and reasonable road the sales person declined as we moved on as we made our way back to the dealership he asked if I did want to try on dirt I sead yes so he indicated a road behind another dealership. When we turned to that road we hit a pothole we didn't notice any major issue so we continued to drive on the short road then brought the vw back and parked it next to my truck then went and tested the hondai we did not test this on dirt because it's a 2wd hatchback when we returned to the dealership a group was gathered around the vw they questioned me about how I was driving insisting they wouldn't go around damaging my truck and insisted I payed for it or I would be arrested we entered negations for trade when they refused to offer me more than $2500 I refused to accept since I was getting offers for $7000 they dismissed this and stated further “I could pay out of pocket through my insurance or leave in a police car” they spoke with a local vw dealership quoting the cost with consumer rate labor at $459 since this was below my decutable and and I did not wish to be taken away by police unaware this is a civil matter not a criminal and not having access to the keys to my truck since they still held them I payed with my debit card so that I could leave. In short they held me and obtained money by deceitful methods they made trade offers and promises that where deceitful and made profit on labor.
