A lawsuit was filed in United States District Court today (Index #11-CIV-1543) against The Allstate Corp. and one of its Atlanta based agents, Bryan Harris, by Tyrone Holmes for Samuel's Temple, a Harlem, N.Y. based church. The Complaint alleges that Mr. Harris used his status and office as an Allstate Agent to defraud Samuel's Temple out of over $500,000.00 via a series of fraudulent investments, deceptive real estate transactions and other ruses, and that Allstate knew or had reason to know that Agent Harris was involved n fraudulent business practices committed while representing himself as an Allstate Agent. According to Tyrone Holmes, Executive Pastor of Samuel's Temple explains "Mr. Harris and I cultivated a fourteen year friendship, and after gaining my confidence as an Insurance Agent for Allstate, he induced me to wire him over $500,000.00 that he said he would use to purchase Allstate Securities, Derivatives and Atlanta properties for the church which would serve as its Southern base of operations, set up a business which I would co-own and for which I would serve as CEO and President of Creative Services and purchase life insurance policies for the church family. In actuality, he used this money to finance his own lifestyle and did nothing that he promised to do. As stated in the Complaint, Mr. Harris even admitted loaning $20,000.00 of the church's money to disgraced Congressman Ron Sailor, who is now serving a prison term for financial improprieties". When asked why the church is suing Allstate, Pastor Holmes replies "Allstate should have known that its Agent was using his office as an Allstate agent to commit this fraud against the church for the following reasons: 1) Mr. Harris used his Allstate address as the address for Blue Box Entertainment, the company that I was supposed to co-own but in fact was set up as a wholly owned corporation by Mr. Harris; 2) Mr. Harris gave me boxes and boxes of Allstate life insurance, property insurance policies and other proprietary and confidential Allstate files to hold because "I was his partner and he had no more room in his office", which I still possess and maintain secure storage at my own expense; and 3) Mr. Harris openly conducted our business and discussed our financial transactions in full view during business hours while in the Allstate office he occupied." When asked how the Senior Pastor, church and church family (including Pastor Holmes' parents who co-founded the church) have been adversely affected by Allstate's and its agent's acts of malfeasance, fraud and/or tortious omissions, and why the church sued Allstate and Mr. Harris for THREE MILLION ($3,000.00) DOLLARS, Pastor Holmes states "the church lost everything, as did our family. Not only did we never close on our Atlanta properties as was promised by Mr. Harris, but the loss of the funds Mr. Harris stole caused us to almost lose our ability to function as a church in our Harlem based property on 125th St., a place we have thrived for over 48 years. Furthermore, my mother, who along with my Father, founded our church school, lost her church school due to her inability to pay the rent, and the desks and cots from the school now reside in our church basement. I personally lost all revenue from Blue Box Entertainment, the business I was to co-own and to which I contributed valuable film and music content. Perhaps the worse part of all of this is that the stress of this terrible ordeal hastened my grandmother's declining health, and she died heartbroken over seeing her family's life work torn asunder. No amount of money could ever help us forget this trauma, but such a sum would guarantee that at least our church would survive into the foreseeable future".
