Hi There,I've recently come into a lot of money via a death in my family and am looking to invest it in property. Looked on the internet a few weeks back and came across this company - Fresh Start Living.I spoke one of the sales guys on Friday 1st July at FreshStart Living and asked who was the Managing Director there and was told it is Andrew Camilleri so I went away to do my due diligence on him.In the insolvency register (www.insolvency.gov.uk) It says that Andrew Camilleri is bankrupt, I've provided the link belowhttp://www.insolvency.gov.uk/eiir/IIRSearchNames.asp?court=SALF_Salford&courtname=SALF_Salford&office=&officename=&OPTION=NAME I've spoken to my solicitor and he said that if a Managing Director is bankrupt then he can't be a Managing Director or have anything to do with running the show at Fresh Start - apparently that is illegal.I called Freshstart Living back again and spoke to a person with a very broad manchester accent called Paul and asked him who the managing director was again just to make sure and he confirmed it's Andrew Camilleri. I then asked him whether Andrew is in the office so I could speak to him, Paul told me he wasn't available but that he is really passionate about the company and around alot and manages the whole company and will meet up with people if they come to their office.I put the phone down because I got massively concerned that not only is the managing director bankrupt but after looking at previous comments on here a lot of people where saying bad things and that the company has countless accounts set up on companies house - it all looks very dodgy. Has anyone on here bought from Fresh Start Living? Am I getting this wrong or should I stay away?I've got over 2 million to invest and need to ensure I invest it in the right way! Please Help! Bob |

Hi, I purchased a student pod in Montgomery House, first FSl did not comply with payment plan, for which I have to sell my car and other things to pay them to complete. than they said rent will be paid from a date which was not justified and now they are not paying rent. If anyone is also not receiving rent please contact me as we need majority of lessee to oust them from the management legally.

Ladies and Gentlemen,
Unfortunately I can vouch for the above, as an unwitting victim.
In good faith, I reserved 5 units at Victoria House in the summer last year. I was told that Freshstart living "owned" the property and that exchange would be within 1-2 weeks. Completion in September (for the start of the new school year, sound familiar?)
I paid £15, 000 reservation fees. No receipt was sent.
No exchange papers were sent until last month (after constant phone calls) and when they were finally sent about a month ago, they were unexchangeable, because they were to do with a different property - not even in Nottingham! Because they don't even own the property. (Surprise, Surprise). So, I am informed by my solicitor that the contract has been rescinded due to misrepresentation and breach of contract. But still no refund or reply to my calls and emails.
I have spent an enormous amount of time trying to recover my deposit money. So far, to no successful outcome. But I will not be giving up. These idiots are going to pay one way or another, believe me.
These guys are total scumbags. This is an orchestrated scam. They just "steal" the reservation fees for property they don't even own, ignore all correspondence and carry on, and then they fold the company. Worse if you actually do exchange (I didn't/ couldn't - luckily) they take the exchange money too. These conmen are psychopaths.
I was even told at one point that one of their salesmen who was sacked had gone off with an ipad and had collected deposit money illegally from clients. Sounds like a pretty good excuse to get some investors off their backs. Was anyone else told that?
One of the directors (Wright, I think) is the director of about 38 companies! And guess what? They are all slowly folding owing shed loads of cash. I really hate these Muppets; I cannot understand how they can get away with this sort of scam in the UK in 2012. How is it possible? I for one am going to make it my mission to make their lives as difficult as possible from now on.
I can tell you that if ever I have the misfortune to bump into any of these 3 clowns; Phillip Wright/ Alan (Paul John) Pierce/ Andrew John Camilleri, I am going to be greeting these MF's with a baseball bat to explain things to them more clearly. So keep looking over your shoulders guys - sometime soon someone is going to loose it with you and you will end up where you deserve to be - hospital.
Hopefully we'll get these guys behind bars soon. Total low life scumbag pondweed that they are.

I am from China, and many Chinese investors were cheated!!!
I paid reservation fee for five student units in Nottingham last July, but last month, in January, their sales Steve, called me and told me that they could not finish the work and asked me to change to another project. I found that is suspicious and refused to change. This Monday, 13 Feb., I went to their office together with an agent from China, they sold student rooms for FreshStart, there I found out they even don't own the property, and neither do they have the planning permision. I found out they are cheating.
I asked the sales director, Paul Walker, to return me my money, but he refused. I have contacted the General Consulate of China in Manchester and they will give support to me if I sue them. And I will go to police station in Manchester city centre today, together with other vitim.
If anyboey want to join us to sue them, or, if you know somebody who were also cheated by this company, would you please / ask them to contact me ? The more people join in, the more influence this issue can make, the less people will be cheated.

Freshstart Living Limited robbed me for 5000 GBP
Fresh Start Living is a twister company. I was interested in two bedroom flat in Empress Mill in Manchester. As a naive person, I paid them for reservation of the flat 5000 GBP in October 2011. They persuaded me that the building works already started and in 12-18 month Empress Mill will be ready.
Also in exchange of the contract I have to pay another 10 000 GBP. They offered me free solicitor, but I preferred another solicitor. My solicitor checked this company and found that they do not have even PLANNING PERMISSION to build this building. Now they do not answer on our efforts to contact with them. I am going to apply to a COURT, if they do not REFUND my money.
Do not trust to Fresh Start Living and do not pay them money without solicitors. |

Has anyone exchanged contracts with FSL and then had the deal pulled out ? This has recently happened to us with very little explanation .. we have no idea if they will keep to their word and refund us, we have also incurred many other fees as you would expect at this stage. Will keep posting any news of this 'non' transaction on this and other forums. |

Like many others here, I foolishly paid £5ooo for a reservation. I have now read all the literature concerning this company and do not wish to proceed to contract even though the Company are pressing me.
Is there any way I can retrieve my ‘reservation’ money. I do not mind paying the £1000 administration but £5000 is too much and my solicitor informs me that this have been placed into ‘a protected pool’ rather than direct into FSL’s account. |

If you think you've been a victim of fraud, you should contact Action Fraud at http://www.actionfraud.org.uk/home. They're the national fraud reporting centre and liase with police etc.
I believe that they will accept complaints from both UK and international individuals, as long as the fraud happened in the UK. |

FS took £43k of us for 3 student pods in Montgomery House Manchester that turned out not to exist and are refusing to return our money coming up with all sorts of bull about selling them on and giving us a profit but seven months later and nothing has happened and they don’t even acknowledge or take emails or phone calls now. Also I believe the two sets of solicitors involved Gateleys and Stephensons have not acted in good faith in this transaction and its aftermath which is very worrying for investors. |

I am so sad that this company is still going. While the director swanned about in a Bentley, investors, lenders, solicitors - and big institutions at that - are being played off against each other. These buildings do exist. But they are not owned nor do they have planning. It is all down to getting enough deposits in and selling off plan, without even lifting a trowel. I am amazed at this new guy thinking he can float this company. Unless he has a major overhaul in mind of the scandalous practices that occur there. People are declared bankrupt - that is not to say they have nothing. They reinvent themselves in another guise and do what they know best. Ripping off punters, staff and apparently the Manchester Evening News thinkls the sun shines. It was a scam and it will be a scam. The projections are good but greed always gets in the way. DO your homework. Don't part with any money unless it is in your solicitors account. Have fun. |

Fresh Start cheated a lot of investors, how can a company like this get floatation? I paid deposit to this company in the July of 2011 for their so called development in Nottingham, but their sales director Paul Walker refused to write down the exact date of the completion on the reservation form they offerred me, and also refused to pay me back my deposit even they can not finish the student house in Nottingham in August 2012 as they promised.
The reason they refused to give me my money back is that they didnt fail to deliver, but if there is no date of completion, they will never FAIL TO DELIVER. According to the information I got, when they sold the property, they didnt have both the planning permision and the ownership of the property. I put a post on the forum of Residential Landlord about my experience with Fresh Start, but their people asked me to take it off by threaten me their legal team was not happy about it.
English is not my native language, maybe the word I used in the post is not very suitable, but now I am writing a report to the local government in China about this company and my experience, definitely this time there will be no misunderstanding, because I am using my own language, and, the most important, I am telling the FACT, before truth, wording or grammatic issue can not be the excuse of lying.

I too recently purchased a property from Fresh Start. It was part of a repossessed unit they had bought from Northern Rock. When they offered it to me, they said all I needed was to make a deposit of 2000 pounds and the rest upon completion. So be it. I decided to proceed. The images of the property were quite superb and I thought maybe a few cleanup inside the house and new carpets, a bit of paint and house was ready for renting out. Infact, before purchasing I several times asked the sales guy how the house was, and each time he's response was so positive - so much so that he insisted I could immediately let it out. Anyway, long story short, before committing my 2000, I asked the sales guy to agree to some of my terms and conditions, especially if the property failed to meet expectations, and that, before exchanging, I would get to view it.
2 Months later, I kept asking them to let me view, and they just wouldn't. Finally after much pressurising, they bent and allowed me to view it. The house was a tipster. It had been damaged beyond small repair. The rooms above had all the timber and wiring sticking out - it was a mess. I took all the photos and headed back to their office to speak to one of the sales guy who I had dealt with all this time. Keep in mind, I had travelled long distance to go view the property. I very politely told the sales guy, that this is exactly what I hadn't paid for and that I'd like my 2000 pounds reservation back. There would be no negotiation etc, but simply give me the money back. His response was, id have to speak to my boss - Phil Wright.
Despite my various emails to the sales guy - i was finally told, that there is no news on getting your refund, and you will have to take the legal route to recover your monies. This is after he promised that he would speak to his director Phil and get back to me. So was this something Phil suggested him to tell me? What was I going to be able to do right?
Wrong. The moment I was told of this, I placed a Court Claim against Fresh Start Limited. Few days later I got a letter confirming that Phil had his solicitors respond to the claim and would defend themselves at court. Infact I was looking forward to going in and fighting this case as I had paper trail and proof of what had been promised to me before making the reservation payment.
A day before the cut of date for court response, I got a call from his attorney. They wanted to settle out of court. They paid all the reservation fees plus all the costs I had incurred.
Lesson ----> Ensure you get terms and conditions agreed to via email before committing yourself with any companies of this sort. It was the emails that put me in a winning position.
Furthermore I had my own lawyer advising me what to do - and I have been told, any terms and conditions that are agreed by email is equivalent to 'contract'. Should they not deliver according to what you have stated in your terms and conditions, they are in breach of contract.
Many people feel that the companies only can put a set of terms and conditions for you to sign, whilst they have nothing against them. This is not true, you too can tie them down to your own set of conditions. And should they not be willing to agree or sign them, then you need to take caution.
I hope this email helps as I see many customers having suffered, and the amounts are way too large.
For those who want their money back, and especially if you have something in writing to which they have been in breach off - take them to court. Your accounts will hopefully be settled.
Just so that you know, all the sales people involved in selling me the property no longer work at the firm. I have to admit, when I walked in the day of the complaint. I saw around a bunch of school leavers (it felt) sitting in a room of around 20 of them like a trading floor and calling up clients (cold calling). Therefore anything that the sales person tells you over the phone, please do take caution into believing what you hear, this is just to get you bought into the deals. They are just young and their income probably is mainly commissions, therefore you can imagine why they are so heavy into marketing.
By the way, someone mentioned a Bentley. Yes when I went to their office to complain, it was parked downstairs and I could almost immediately guess who it belonged to. |

Really dishonest and unethical company. My advice is to stay far far away. Perhaps even leave the planet earth.
I lost tens of thousands.
In my case; They have failed to deliver on selling property they categorically stated (in writing) they owned but DID NOT OWN (Victoria House, Milton Street, Nottingham - Check the land registry). Now, they are trying to keep my deposit money under the guise of signing a “non refundable” deposit.
They said they owned the property, conversion was almost complete and we would exchange contracts in a few weeks and complete before the end of LAST YEAR. It turned out that they NEVER even owned the property in the first place. They now expect to keep my deposit (and many others that I am in direct contact with) in case they might be able to purchase this property at some undefined point of time in the future. Totally unacceptable and unreasonable in the eyes of the law.
They obtained "deposit" money from me by MIS-REPRESENTING THE FACT THAT THEY OWNED THE BUILDING and REPRESENTED AN UNREALISTIC TIMESCALE FOR PURCHASE. I relied upon their representations prior to signing the purchase agreement. This was, in the opinion of my solicitor; either negligent or Fraudulent behaviour. You decide.
Now, after spectacularly failing to obtain the freehold to the property for over ONE YEAR and after ignoring most of our phone calls and emails they expect to keep our money?
Disgusting and outrageous behaviour. Not a reputable company at all.
They have acted despicably after their mistakes and refuse to pay us back the deposits that you owe us. |

Montgomery House landlords are taking action against Fresh Start Living who are failing to honour their rental guarantee agreements. A number of landlords have received nothing since June 2012!!
This situation is alarming as we understand that all pods in the property are currently rented out to students, many of whom have handed over rents for the entire academic year to Fresh Start.
However Fresh Start appear to have so far pocketed the money as many landlords have either received bad cheques or are being fobbed off with the following excuses - promises to pay by the end of the week; computer systems failure; or blaming individual employees as dishonest, incompetent or both!
