Ebay gave my item to the buyer, and ruled he could keep my money. Then they still charged me 9%, Internet

Ebay's customer service policies towards their sellers are absolutely terrible. I recently sold a cell phone on Ebay to a guy living in New York. The buyer claimed that the never received the item. He opened a dispute against me with Ebay. I provided my ticket number from the post office and explained the situation to Ebay. (I had called the local post office in the buyers area and they told me that buyer receives packages everyday but that there was no chance my package was lost and if it had not been delivered I would have received it back.) Ebay did not care in the slightest. They sided with the buyer and pulled the full amount of the money out of my paypal account without my consent. They gave it all back to the buyer even though I was now without my cell phone (which was worth over $500). I called Ebay to discuss the situation with them directly because they would never respond to my emails. After going through the unprecedented horror involved with trying to get a hold of a living, breathing, human being employed by Ebay; I was basically told that they do not care about the rights of the seller. I was told that they realized that upon my mailing the item, according to common law of contracts, the deal was final and I would have been entitled to keep the money. By using Ebay though, I had deprived myself of the laws of the U.S by clicking "I accept" when I first created an Ebay account years ago. Here is the kicker though. Ebay charges 9% for every item you sell. That is how they make most of their money. Two weeks after this debacle, when I was finally ready to forgive Ebay, I received an invoice charging me $40. I called Ebay assuming it had to be a mistake. The customer care rep assured me that it would be handled within 24 hours and that I would receive an email confirming it had been credited. The email, of course, did not come. So I called Ebay for the third time, after being on hold for 15 minutes, I was able to explain my story to one of their reps. She then promptly assured me that there was absolutely nothing she would do to help me. I told her that 9% of zero dollars is zero dollars and that it was not right to charge me when I had not been able to successfully sell my item. At that point she told me to go ahead and not pay and she would be happy to send me to collections! I asked to speak with her manager and she told me they were in a meeting and could not be interrupted. I informed her that it was 6:43 pm pacific time on a wednesday evening and asked when they would be finished with this supposed meeting. She then told me that they are in a meeting at all times and only communicate with the other employees through an occasional memo! I asked her how many managers were in this meeting and she said, "about two!" What a joke. The moral of the story is, do not do business with Ebay as a seller. They have absolutely no interest whatsoever to treat you with respect. I will never do business with Ebay again.
