THE LAST WILL AND TESTAMENT OF LUTHER A. GARLINGTON (THE ADMINISTRATION) The Will was probated April 4, 2007: Case No. 07P20 Judge --- Mikesic, Presiding. Martha Evans, sister of deceased was appointed executrix. Attorney for the plaintiff, Martha Evans was Kathryn P. Barnett. Petition for homestead filed by Alyce R. Edwards was taken under advisement. Attorney for the petitioner, Alyce R. Edwards was Michael Martin. Judge Mikesic ordered his arguments on the homestead petition to be in by April 18. The Petition was filed on April17, 2007. Judge Mikesic retired May 1, 2007 without making the decision he promised (at the April 4 session) would be made regarding homestead without the need for additional hearings. The Petition for Homestead was denied August 16, 2007 Case No. 07P20 Judge Kathryn Lynch HEIR PORTIONMENTS, per will: Helen Maedae Qualls, sister (deceased) One Quarter Share Lance Davis, nephew One Quarter Share Karen Madison, niece and Michael Garlington, nephew One Quarter Share Alyce R., Peter, Timothy Edwards, step-children One Quarter Share During "Discovery" of the "LAST WILL and TESTAMENT of Luther A. Garlington it was discovered that Luther A. Garlington had inheited extensive debt in the form of medical bills after the death of his wife Alice Garlington from cancer that were in excess of $40,000.00. Peter Edwards her son was named the "Executor" of Alice Garlington "Estate" in conlusion with Alyce R. Edwards did not pay the medical bills that were incurred after her death. The "Estate" received a very large substanctial insurance compensation payment. However Peter Edwards the "Executor" upon receving the monies failed to pay the hospital / medical bills that were accumlated by Alice Garlington. Peter Edwards, Timothy Edwards & Alyce R. Edwards instead divided the insurance monies among themself, leaving Luther A. Garlington the husband of Alice Garlington absolutely no money to pay the hospital / medical bills that were incurred. Peter Edwards failed at his fudiciary obilgations to pay all debt. His "Ripoff" sent 74 years old Luther A. Garlington into immediate extensive debt. Garlington who after returning from world war II built his home with the farther. After Peter Edwards and his siblings actions Garlington began getting bombarded by creditors. Garlington who's home was free and clear from debt, took out a loan to pay off his wifes medical bills. Garlington who was retired Postal Worker & U.S. Veteran quickly found himself in unforgiving debt living off his credit cards while Peter Edwards and his siblings celebrated their ripoff. |
