I lost my job in 2009 and got severance. I knew I would not be making as much once my severance ended. I applied for a loan modification in 2010 with Wells Fargo. at that point I was not behind on my mortgage and denied. Apparently, you have to be behind before they will look at you for modification. I started to fall a month behind in June 2011. I again contacted them and got a hud counselor involved. Went back and forth. They would never tell us when we needed additional paperwork. We had to pursue them. They would ask for one thing and then need a different thing. Each time I called, they said your paperwork is not with the underwriter yet and it will take 4 to 6 weeks from that point. My call in August 2011 gave me contact with the one honest person I ever spoke with. She said you will never get a modification because of your high amount of bills versus your income. No one had said that before. I filed for bankruptcy 1 month later. In Oct. I was 3 months behind and not in foreclosure proceedings. I received a letter on Oct. 14th stating I could not be modified because they did not have a contractual agreement with the investor holding my loan to modify under MHA(make housing affordable). they did not know this in June 2011? Next I get a letter introducing me to my bankruptcy representative at Wells Fargo. He gives me a phone number to call. I call and leave messages. His message says to press 0 to contact another representative if he is not there. I press zero and get invalid option. I finally call a different number and in a roundabout way get to another person who tells me he can't call me back unless my lawyer signs a consent. Nowhere in his letter does he mention that. Consent sent and receipt confirmed with someone at Wells. More messages for my representative. Still no return calls. The rep who told me I needed the consent did tell me they filed for a motion to stay(my lawyer says they have not done this yet) Oh, and I am still in the process of being modified(really,they have no current paperwork from me) All the letters, I have gotten in the past mention all kinds of help, loan modification, forebearance, etc. None of this is being offered to me. I am 3 months behind and they would rather foreclose then work with me. |
