I have to say I have seen some crazy tactics by collection companies and Ive heard some weird stuff come from collection companies. But this 1 takes the cake! This Con-pany is called Upstate Management Services LLC, They collect on anything that has some "value", keep in mind folks that although it is a VIOLATION OF FDCPA for a collection agency to lie, use vulgar language, not identifying themselves as collection agency; the list goes on and on....But i have to say they are slick, calling from a blocked number, "call trap" I was able to see who it was, but they let a voice-mail claiming "we are gonna serve you etc..." So I call back the number listed "1-877-211-6661" gave some file number and they say pretty much everything under the sun! What gets me is why talk about it? I stated the facts such as: If your con-pany was gonna sue, why wait 3 years? When I asked if they were a collection agency they hung up! I call back sayn you want this "money"? Then you better get LICENSED in the State Of Florida to collect it! Never the less, no one ever came then "8 months ago" to "serve us, and the odds are super slim as to being served now! In other words DO NOT BE AFRAID of these a** clowns, If they HAD AN IRON CLAD CASE, TRUST ME THEY WOULD'VE SUED YOU/US ALONG TIME AGO! What con-pany is going to hire attorney in another state to collect on something less that $500.00? The cost exceeds the value of the "note/debt" Now the big question was "can I get a copy of a financial agreement that states I or someone owes this alleged debt"? Nope, so with that being said why pay, if they aren't willing to prove to me that I owe them!?? LOL I love this country! At the end of the day, this just another scare tactic to make someone pay, and if you in a consumer friendly state, and being harassed by these a**wipes, just check with your states financial bureau, they'll tell you if they are legally allowed to ATTEMPT to collect from you in your home state! As Florida, they are not even close to legal! Now here is the proof of their bullshit getting them into trouble! | I have also been contact by these jokers for 3 days. A "Tommy Smith" from ** County calling to notify me I will be serviced and "certified intention to appear" in court and ending the call with "you have been notified". I called the 877# given and they wouldn't give name or why they were calling. I contacted an attorney and this is a scam from NY. I am supposed to be "served" today so I guess I will see. Scary that they have all my info. |

| yeah i just got one today also, saying the exact same thing. a Tommy smith left a message on my phone, i called the 877 number back and there was no tommy smith, i spoke to a david, he told me they were getting me with fraud but i could take care of that with three options, #1: settle for $400.00 today only #2: settle for 2 payments of 220.00 or #3: pay the full amount of 962 in 6 months. I have to admit i was freaking out, but the more he talked the more i knew it wasnt right. so i asked him what the name of he company was again, and he said it real quick, but i got it, and decided to take a look. |

| I got the same call tonight and I was freaking out! They even called my parents! This is crazy! But they called me from an anynomus number to, then some clleen lerego, said to call back 1-877-236-2361. When I called the number that I seen on here I got the same company! So this number I gave is there other number just to warn you. |

I WAS CONTACTED BY " DVID ALBERT " FIRST HSAI HE WAS AN OFFICER THEN HE SAID HE WAS AN ATTORNEY AND THAT A SHERIFF WAS COMING T MY JOB ON MODAY THAT I SHOULD HAVE BAIL AND AN ATTORNEY AND THAT I WOULD BE FIRED I ASKED HIM WHAT PAY DAY LOAN CO WAS STATING THIS HE SAID HE WOULD NOT ARGUE AND THAT I SHOULD BE READYFOR MONDAY.

| My father got a call from some guy that said he had went by my house to subpoena me, which is bulls**t because my wife was home. My dad gave me the number and I called him back and he said that I owed 964 for a payday loan and that I can take care of it over the phone. I told him to mail me the details, he said he can't but he could email me the info. The next day I get a call from Tommy saying I will be served Monday, I said ok and hung up. A hour later David calls me back, coincidence? I think not! The email i got was from a gmail account no less, real professional. Their website www.upstatems.com is registered to a Kelly Brace and has been up for not even a year. Their address on the email and website says that they are in suites 303-309! Unless they have employees that work at Chez Ann Salon or the UPS Store then there full of sh**!!! I can't wait for them to call me back so I can tear into them, they messed with the wrong person! Knowledge is power! |

| I got one of these same calls. The person who called me name was Aaron Rizzo.He actually called my home number which is suppose to be unlisted but he obtained it. He told me that he was due to serve me this week Thursday August 18, 2011 with a Notice of Intent for me to appear in court. The number he left me was 1-877-211-7412. I called it and the voicemail indicated that they were Upstate Management. So I googled it and found out about this scam. So apparently they are aggressively collecting for pay day loans. I will admit I was kinda scared but now I feel much better. I will be sure to include this butt holes in my BK filling |

| I neglected to add that this Aaron Rizzo did not call from a blocked number he call from an office County number in my city. So that made me nervous. I called the number back and was the Main County Jail of my City. I know this is beyond fish. I will not even call back and will change my home number to make sure it is not listed again. |

| I have gotten calls the last 2 days from the character named "Tommy Smith". I did not answer either time because I work nights and am asleep during the day when they called. He left a voice mail each time saying he was from Tarrant County, which is the county I reside in, and that he was calling in regards to paperwork submitted to his office by a group of attorneys. Now of course I did get a little nerve rattled when he mentioned he was from my county, but after thinking for a second I realized that he could know this simply by knowing my address. Also, I knew something was not right with this call when I saw he called from a blocked number. He also said that he is coming to my house today (Septmeber 2, 2011) to serve me with papers. I then recieved a call from my dad. He told me that they contacted my step mother saying the same thing, and then I thought REALLY???? my step mother??? of all people?? I decided to google this number he gave me to contact him at 877-211-6661. And that is when I came to find out about this scam, although I was already pretty certain it was a load of BS! In my state of Texas, I hear that we have the most leanient laws when it comes to people that have debts. I looked them up, I could sue this company big time. After looking at the laws, I see that it is ILLEGAL for a collection agency to lie to a person about their intentions or actions, or to contact the persons family members and lie to them as well. Im pretty sure I will not be making the trip all the way from NEW YORK (which is where I have found out this company is located) to my house in Texas just to serve me today. It is kinda scary that they have all my info but still these guys are scam artists just trying to scare people into giving up all their money, which is way more than they really own on their debt. I certainly hope they havent ripped too many people off with this scare tactic and taken way more money of the money than they owe. Remember people anytime someone tries to say something odd, just google it! |

Glad, I found out the name of this company and googled it.. to read all this.. Michelle Williams has called me for 2 days saying she will be here on Thursday to serve me- of course from a blocked number. I found it odd cause I know normally a county will not give you a courtesy call before serving you, and its illegal for them not to identify themselves.. They just serve you!!!
They have been calling my ex-husband as well. He told me they have the wrong address anyways.. I was going to pay the settlement amount till they told me they couldn't do a check by phone or an ach withdrawal. Said to send it by money gram. Course then gave me the company name which brought me here. I called them back told them to email me the documents that I actually owed them this money. He said it had been charged off.. I said then I don't owe you and you are not the original debt holder. He hung up on me. |

| This is all interesting because I have had the same issues as JH00. I have had a guy named Aaron Rizzo calling my house for th past 2 days leaving a message for a friend of mine saying that he is a process server and is scheduled to be at my house today to serve her papers for her to appear in court for the litigation that has been filed against her. The number that he left is 877-211-7412 and when I call the number, I get nothing but a busy signal. I am knot even sure how he has gotten my number under my friend's name. She has never lived at that address. This creep even leaves a file number to refer to for the case. Beware!!! |

| i have been contacted by these idiots even after filing Chapter 7 Bankruptcy., however I did call them back and get on the defensive side since I am persuing legal action against these people with an attorney, because the call they sent me from a legal courier wanting to serve papers is all a bunch of ####. When I confronted them, they said it did not say that and that it was a courtesy call, and I advised them that my attorney listened to the call and you were threatening me with subpoenias to persue legal action, when in fact it was just a lie. They did not seem to care one thing about the situation, stopped payment, and told them I will see them in court, so this week, I am meeting with my attorney to forgo charges against these people. |

| called and said my son took out a loan (which he was 15 at the time), I called and reported it for identity theft and they called his grandma and she paid. OMG, filing federal lawsuit. They are fraud. |

Hello Everyone...after reading all of these comments I too have just realized of this scam. I got a call from a Robert Fisher. Upon calling the number left by Robert Fisher aka "not a real person" there was no Robert there. I asked if they were a collection agency and the woman became extremely rude to me. Then she transferred me to someone else. Of course, I was told I was going to be served and funny, in the initial message by Robert they had some strange ass addresses for me that I NEVER lived at. Anyway, thanks everyone for posting these messages because I was truly concerned that I WAS going to be served.

Hello all. I have been called by "upstate management" for the past 5 months. I keep well track of my finances, yes i have debt and i'm not by any means "perfect" but i know what debts i do and do not have. Then they asked for a Michael *last name*. This not being me i asked for my number removed. they keep calling and finally i called them out today. I asked if they represented a law firm and David Figaro the person i was speaking to said yes and that he would transfer me. Then i got a guy who would not give me his name saying he was not in a law firm that they were a group of attorneys to collect debt. When I pried information on this "debt" he then back peddled and said the company is a group of lawyers that sue other lawyers. I asked for a physical address and said and i quote "I highly doubt your going to visit me, I am in upstate NY" this is viable information since i was calling and do live in SW Missouri.
So i tell him i have family in Syracuse (which is true) and its not that far of a drive. "Well i don't have to give you an address" was his reply. At this point i know this is all fake so i start being a jack-a** and start yelling and cursing and threatening to sue for harassment which went something like this
Me: i'm going to sue you for (explicit) harassment with your (explicit) fake company and impersonation
guy: who said i'm impersonating? did i say that?
Me: No but you cannot give me proof i have a debt, you keep calling me and several websites say your a scam.
guy: so your going on what the internet says about a company?
Me: yes i am also here's dockets proving your court "experience" (starts giving docket numbers)
guy: (interupts me after half a docket number) do not call here again or i'm going to sue your *explicit* for harassment
Me: good then we understand each other then, dont call me or i will also sue you for harassment
guy: thats what i just said, are you just going to repeat what i say now?
Me: i'm just verifying that you are not going to call me again or i will sue
guy: dont ever call here again *hangs up on me* |

| i have gotten a call from upstate management services stating that i would be served with certified court papers for me to appear in court no later than 11-16-2011. the call back number was 1877-211-3261. so beware they are using different phone numbers. when the person called me the number came up private so i different answer it. they left a message on my phone. i am glad that i googled this company and see thats its a scam. |

| I have gotten calls for someone I don't even know, when I called the number left on my answering machine I spoke with a guy name: Ryan. I explained that I did not know this person and to please stop calling, he said the calls would stop. Next day same thing more calls, again I called an spoke with Ryan, again he said calls would stop. 2 days later calls start again. So once again I call and talk to Ryan only this time he starts cussing at me telling me I was a lair, and that they would now call everyday all day. I said fine, then I would have to sue them for harassment, he so (cuss word) do it. and hung up. I mean come on I'm not even the person they are looking for. |

These guys threatened me earlier this year and have started again. I am from Louisiana, so the way i caught him was when he said "I have a docket for you for _______ County"... LOL... We are the only state that does NOT have counties... so if he really had a docket or any paperwork relevant to a judgement it would clearly say "Parish" ...
I called the number he gave anyway just to see what they would say... the conversation was hilarious and he said i was going to be charge with "theft of good & services" I laughed and said "what did i steal? You said this was for a loan, which is a debt, which is civil. therefore, u cant bring me up on criminal charges."
at that point i guess i pissed him off because he said "im hanging up, your too stupid to waste time on"
LMAO... honestly it was entertaining ... i laughed at him several times which is probably why he got so mad...
i called back and started asking them questions like
"whats ur mailing address?" "whats ur fax number?" I need the email to ur supervisor. oh you dont have it, then get it for me please" oh i can only talk to him but i cant have his email ... hmmm... LOL... sorry guys but too many people KNOW the law... WHAT A WASTE OF A LIFE to spend time harassing people ... |

On 1/3/2011 I was left a message by Erika Rodgers who identified her self at a process server. The message stated that legal action was pending and I needed to contact. The person planning to pursue legal action. The person gave a number of 877-235-7624 reference number 1443-15. I contacted a Shawna who stated that she was with a legal firm called Upstate management and they are attorneys representing Cashnet. They gave information about a debt I owe and they were willing to not pursue legal action against me.
I asked if they had bought the debt from a previous collection agency the representative stated yes. I stated that if they were already going to serve that they had already filed the lawsuit. The representative stated that she was going to speak with an attorney. The representative came back after a few moments and stated that the attorney said that it had not. The representative stated that to avoid service I should pay a lump sum or six payments. I asked on numerous occasions if the company was a law firm and she stated that they were. I stated that I would get back to them in 24 hours.
As a retired police officer I did a brief investigation. I was able to find numerous complaints and a lawsuit out of a district court in New York that is pending and legal opinions have been given by the judge stating that they are debt collectors and must comply with the FDCPA. According to section 1692 of the act it states that a debt collection company may not threaten legal action. Upstate management is in clear violation of this act.
Also for those in Texas you cab file a complaint online with the Texas AG. Remember there is no wage garnishment in Texas for bad debt. |
