I have to say I have seen some crazy tactics by collection companies and Ive heard some weird stuff come from collection companies. But this 1 takes the cake! This Con-pany is called Upstate Management Services LLC, They collect on anything that has some "value", keep in mind folks that although it is a VIOLATION OF FDCPA for a collection agency to lie, use vulgar language, not identifying themselves as collection agency; the list goes on and on....But i have to say they are slick, calling from a blocked number, "call trap" I was able to see who it was, but they let a voice-mail claiming "we are gonna serve you etc..." So I call back the number listed "1-877-211-6661" gave some file number and they say pretty much everything under the sun! What gets me is why talk about it? I stated the facts such as: If your con-pany was gonna sue, why wait 3 years? When I asked if they were a collection agency they hung up! I call back sayn you want this "money"? Then you better get LICENSED in the State Of Florida to collect it! Never the less, no one ever came then "8 months ago" to "serve us, and the odds are super slim as to being served now! In other words DO NOT BE AFRAID of these a** clowns, If they HAD AN IRON CLAD CASE, TRUST ME THEY WOULD'VE SUED YOU/US ALONG TIME AGO! What con-pany is going to hire attorney in another state to collect on something less that $500.00? The cost exceeds the value of the "note/debt" Now the big question was "can I get a copy of a financial agreement that states I or someone owes this alleged debt"? Nope, so with that being said why pay, if they aren't willing to prove to me that I owe them!?? LOL I love this country! At the end of the day, this just another scare tactic to make someone pay, and if you in a consumer friendly state, and being harassed by these a**wipes, just check with your states financial bureau, they'll tell you if they are legally allowed to ATTEMPT to collect from you in your home state! As Florida, they are not even close to legal! Now here is the proof of their bullshit getting them into trouble! | trish-I was called by someone named Sarah at work and on my cell threatening to take me to court and come by my home and work and I HAD BETTER BE AVAILABLE. She left her # which I called and found out was Upstate Mgm-a collection agency, I just told them to feel free and come by but bring police d/t if not I would have them arrested. |

| I received a call from this company today and when I listened to the voicemail it was a gentleman by the name of Rick Shaw stating that criminal charges are going to be filed against me for check fraud. I was stunned and curious to know what in the world was going on. So I call him back to speak to him and he tells me that I opened an account up with ACE check Cashing. I have never been to this place before in my life and frankly I don't need to borrow any money when anyone because I have my own. So I asked him what place is this or the location that I went to where I supposedly opened a loan and committed check fraud. He preceeds to tell me that he doesn't know which location it was but they have video and he will be turning everything over to the local sheriff's department so I can be served and I will have to go to court. Well that is what they will have to do because I have never been to this place. I have never borrowed any money from ACE. If they are trying to ruin me then I will get me a lawyer and sue they ass for punitive damages. I am not with this. I am so glad that I got on this website now I know that this is a scam. |

| i got a call today from a lady telling me that she is from san diego county court, and there's someone that filed fraud charge against me and that i have to appear in court, and she told me that i have to call this phone number8772321925 and she even give me a "case number". so i called that number and asked them if they really filed fraud charges against me but they didn't wanna talk about it, at first they said that they don't know about that lady who called me but when i told them that it was the lady who gave me their phone number and case number they said that "she works for your county court and not for us" and i told them that i will go to court and will ask them about the fraud charges and they told me that i dont have to do anything about it as long as i pay them 489.00 dollars or 94 dollars a month for six months, and i told them repeatedly that i am an unemployed single mom and that t hefather of my baby give me only 500 dollars a month but they keep on harrassing me, telling me that i dont understand what they're trying to tell me. i was really scared, i told them that i am going to call them back but they said "no! dont hung up unless you give us your credit or debit card number" and i told them again that i am going to court and he tried to stop me again. and he insisted that i have to give them my card number. i was really scared and until now i am so scared and i do not know what to do. help me please. can i go to court and file a complain against them? i am so scared. |

HE ALSO CALL ASKING FOR MY HR DEPT. WHAT CAN I DO PLEASE CAN SOME POINT ME TO SOMEONE OR WHERE CAN I REPORT THIS. THEN HE SAYS I CAN CALL TO THE CLAIMS DEPT TO RESOLVE THIS AT THIS NO. 1 888-837-3582. HE CALLED YESTERDAY SAY HE WILL BE AT MY JOB BEFORE NOON THEN CALL AT 2:34EST SAYING HE ON HIS CELL AND HE WILL HERE IN AN HOUR. HE CALL TODAY SAYING THE SAME THING. Depends where you live Venn73 and who is harassing you.. If you are in the US, nothing can be done for you or against you, unless you were an Arab or a terrorist suspect or haven't paid your taxes, sorry to say that. The police is lame and attorneys will charge you over 7000 dollars..

| to Venn73. dont worry you are just being illegal harassed by scum bag felons acting as debt collectors. Debt collectors cannot call you at work if you tell them not to. It is a violation of FDCPA for them to disclose a debt to anyone; it is violation of FDCPA if they talk to your employer. Another clue they are scum: lawyers dont call you before you are sued; process servers dont call before they serve you; courts dont call people if they are sued; court papers are not certified; you dont show id to a process server; you dont sign for papers when you are sued. They are bottom feeeding scum sucking pigs who used to be telemarkets; they just got out of jail for defrauding people through telemarketing and now they are on to a new scam. If you life in LA, TX or CO and they are calling you they are violating even more laws. Write your attorney general, the NYS attorney general and call a lawyer. |
