First, I encourage prospective customer to get both sides of the story and do the research themselves (Ill provide sources). Second, any name mentioned in this report is used for factual reporting only. I do not intend to disparage anyone, and I encourage readers not to look down on anyone mentioned in this report. To my knowledgefrom evidence I have in possession and unless I see documents to the contraryI believe that The Courtyard at Mount Hermon LLC (which is co-owned by Alex Perkins and which operates businesses including The Highlander Restaurant Lodge & Pub on Riverside Drive in Danville, Va., and Courtyard Salon on Franklin Turnpike), apparently may be and/or have been in violation of multiple state laws designated as criminal offenses. These apparent violations include: 59.169 et seq. of the Code of Virginia 13.1-613 of the Code of Virginia 59.1-200 et seq. of the Code of Virginia 58.1-2402 et seq. of the Code of Virginia Also, in a letter I received dated April 14 with a return address of Mt. Hermon Courtyard and signed Alex Perkins, I was asked to remove my Jan. 29, 2010, post on ripoffreport.com about the company. In addition, I apparently was threatened to be sued. That letter was the first I received in response to my letters after more than two years since a March 27, 2009, incident. Since what I write is true and accurate, I have no problem defending any allegations against me. Plus, that report and all other ones will not be removed. I told the company on June 15, 2010, that it apparently was in violation of state laws. Since nothing was done about correcting the apparent violations as of March 7, 2011, I wrote a letter to Alex Perkins of Mount Hermon Courtyard on March 28, 2011, reiterating the state laws and explaining how the company can fix the apparent issues. I asked the company to do so by May 1, 2011. As of July 1, 2011, I have checked and still have not seen any corrections made. To my understanding from the facts I have, the following laws apparently were violated: 1. 59.1-69 et seq. of the Code of Virginia, because The Courtyard at Mount Hermon, LLC, has not registered multiple names it apparently does business as, which means the company apparently has no authority to conduct business under those names (I believe the law was created to prevent fraud). Some of the names were on courtyardstorage.com and were still there as of writing this letter. According to the State Corporation Commission on Friday, July 1, 2011, The Courtyard at Mount Hermon, LLC, (S068903-6) only has these fictitious names on record as of June 30, 2011: a. 06/16/06 - COURTYARD SALON (PITTSYLVANIA COUNTY) b. 09/21/10 - HIGHLANDER OF DANVILLE, THE (DANVILLE) c. 09/21/10 - HIGHLANDER, THE (DANVILLE) Unless I see reports stating otherwise, I understand that The Courtyard at Mount Hermon, LLC, in Danville, Va., also does business under the names Mount Hermon Courtyard, Mount Hermon Courtyard Conference Center, Stratford Conference Center, Stratford Courtyard, Mount Hermon Courtyard Mini Storage (and the many other unregistered names the storage business that has five locations apparently goes by such as Courtyard Mini Self Storage Company, Courtyard Mini-Storage, Courtyard Storage, Courtyard Mini Storage Centers, Courtyard Self Storage, and M.H.C. Mini Storage, Inc.). To my understanding, it is a criminal offense if a company does not register fictitious names it does business as. Other company names used are on a March 27, 2009, contract. 2. 13.1-613 of the Code of Virginia because the company is not incorporated as M.H.C. Mini Storage, Inc., as it had stated on its Mount Hermon Courtyard Mini Storage contract of March 27, 2009. For verification, visit https://sccefile.scc.virginia.gov/. The name is used on a March 27, 2009, contract. 3. 59.1-200 et seq. of the Code of Virginia, a.k.a. the Consumer Protection Act, because it advertises on its website courtyardstorage.com free moving trucks as reasonably understood with payment of a storage unit. There is no disclaimer or indication whatsoever that there is actually a rental payment in the form of a mileage fee, as was the case with a truck rented March 27, 2009. Since the company advertises free moving trucks, and even if an employee said otherwise, I believe that the law is clear that the advertisement must be honored. Other information is on a contract of March 27, 2009. 4. 58.1-2402 et seq. of the Code of Virginia, concerning the rental of trucks. The DMV was contacted last year about apparent violations and investigated the matter. The company apparently was not in compliance, but allegedly now is since last year. A May 5, 2010, letter from the DMV stated that they will bring them into compliance. A July 6, 2010, email from the DMV stated, We are still working with the company to get them licensed and that the company should be licensed as a rentor and charging rental taxes that are equal to 10 percent of the gross proceeds. An Oct. 28, 2010, email confirms that the company, as of then, is licensed with us and is remitting taxes monthly. Other violations reported include those pertaining to food safety inspections at Mount Hermon Courtyard. This is not concerning the recently opened The Highlander Restaurant Lodge & Pub. The food safety issues apparently have been fixed.
