Ok, So did my taxes at the end of January. Recieved my "partial" tax refund on 2/4/11. Both my state, and federal returns had a "tax offset" placed by the one and only State of Indiana. They say that I was $721 behind on my child support obligation. Ok. I have a job, the only reason I was behind was because I got laid off from my last employer after 5 years of service, so, I fell a couple payments behind. My ex wife and I agree upon my tax return taking care of my arrearage every year if i'm behind. We both did not think I was that far behind, but you cant argue with the state right? So they, the great state of indiana, takes 721 out of both of my tax returns, plus they take an extra 20 out of my paychecks for arrerage, which makes it less and less every paycheck. So, they have $1442 of my money, for a 721 debt. Ok, I call the state of indiana child support bureau, and let me tell you, it was a joke. I have called and called and called them, and not one person that works for this state knows anything about their jobs. Not one of them could tell me the exact same thing the previous customer service rep told me. Everything I heard from them was different. They was telling me that I'd have the excess money that was taken from me returned as soon as the payment posted to my child support account. Has it posted yet? No, no, no, no, no...... I was told it had a 6 month hold on it because my current wife and I filed a Joint return. Ok, my wife did not work at all the 2010 tax year, so she is not entitled to any of our return, besides, we're married. We live in the same house, under the same roof, in the same bed. So, they tell us we have to have her sign a paper stating that she was not going to file an Innocent spouse relief form, and that as soon as they recieve that, they can release my money and post it to my account. I have never dealt with an state agency that did not know how to do their job like the child support bureau. I feel so sorry for all the other ncp's out there that have worse problems than this one. I really think that the state should have to pay interest for us non custodial parents when they take our money, more than double what we owe, and they just hold it, for no reason. Thats so stupid, but look who were dealing with........ |
