Unauthorized extension of contract |
18th of Sep, 2011 by wheezil |
I think this is best explained by my letters to Sprint (and later, collectors) . This of course had no effect whatsoever; they simply referred my account to collections, which failed. Then they issued a bad credit report for me, which I had removed. They are unscrupulous trolls. What a huge godawful waste of time and energy. I've redacted the identifying bits.

To Sprint Customer Service:
I recently received a letter (copy enclosed) from Sprint asserting that my contract had been extended. My account PIN is XXXXXXXXX.
I did not authorize this contract extension, nor was I informed of any such extension and given opportunity to consent or decline. As such, I consider this unilateral extension of my contract to be invalid, and I will treat my contract as if it will expire on the original date of XX/XX/XXXX.
Presumably, this was triggered by some automatic processing logic in your system, in which the activation of a new device (Dell Precision M6500) is considered to be an implicit contract extension. However, I was not informed of this by Sprint, or during my purchase from Dell; it is not mentioned in my Dell contract, and my Dell order shows the device as unlocked, supporting multiple carriers. Nor was this mentioned during my conversations with Sprint during activation of the new device. Nowhere in any verbal or written communication from any party concerned is there a statement to the effect that activating this device would extend my contract term. As far as I am concerned, I purchased an unlocked mobile data device at full retail with no contract.
I have spent over two hours on the telephone with your account escalation specialists, have endured being disconnected more than once, and your representatives have of course declined to give me any information by which I can follow up on the case. My last conversation ended up with the Sprint representative transferring me to Dell support, apparently believing that it is my responsibility to prove that I did not authorize a contract extension. And your representative hung up before Dell answered. But that is backwards. It is Sprint’s burden to prove the validity of the contract term extension by producing relevant documentation of my authorization or consent. I do not consider any agreements that may exist between Sprint and Dell to be relevant, as such agreements have no legal bearing upon my person. Nor do I consider statements to the effect that it is Sprint’s standard policy to extend contracts when a new device is activated to have any legal bearing. Of course, should you show me that I did indeed authorize the contract extension, I am glad to admit any oversight I may have made.
Don’t misunderstand me. I have nothing against Sprint or its service. In fact, I’ve rather enjoyed the use of my data plan. I don’t even object to the cost (obviously, as I just spent $XXXX on a laptop). But I do object to being told that I made an agreement that I did not make. Once you return my contract date to its original expiration, I will make my own decision at the end of the contract term.
For your reference, my Dell order # is XXXXXXX. I’ve attached the order and associated terms and conditions.
Sincerely,
John XXXXXX

To whom it may concern,
As indicated in the attached letter, previously sent to Sprint Customer Service with supporting documentation, I do not consider Sprint's unilateral extension of my contract without my knowledge or consent to be valid. Therefore, I am considering my service to be terminated on the original expiration date of XX/XX/XXXX.
This is my last payment.
Sincerely,
