How will YOUR class action be any different than USA/Curry v. Fairbanks from 2004?
FYI, 25 or so law firms split $8.75M in that action. 280, 000 victims split $40M. That's roughly $300k per firm vs. $143 per victim.

It's about time somebody did something. while under probation from the FTC this servicer continued it's same practices. I have been fighting with them since 2007. They never even got my 1st payment right. My PMI was cancelled due to fraud in my file (that SPS did not notify me of). I suddenly had over 13k in my escrow and no one could tell me why. I finally had a mortgage underwriter friend get to the bottom of it. I have been trying to find an attorney to sue them myself. |

Your Idea is good about getting Select Portfolio Servicing in Court. However, as I have learned Select Portfolio has agained protection in the Third Circuit Federal Court. The Judges are altering peoples charges to try and dismiss their counts, for example if someone claims the charge of Unlawful Enrichment which consists of fraud the Judges will alter the Title to Unjust Enrichment and claim it's not a legal charge. Therefore, Courts don't always help. |
