Here are my emails with the Ebay seller Coolsam76. The Gist of it is I spent $309 on a hardrive that did not work. First I sent it back to the manufacturer per the seller's request. When they could not get it working, I demanded that the seller take it back. The seller even resorts to calling me "a person of no patience," in his last email. Here are my emails with the seller. Your state and Virginia where you shipped this drive are subject to the Uniform Commercial Code, which requires that you put me in the position I would have been in had I not done business with you. If you are a good business person, you should be disgusted with the idea that I would be required to pay 34.50 for shipping your broken drive that you did not want to refund to the manufacturer, 34.40 (presumably) to send it back to you, and another 30+ for you to supposedly restock the item. You received 309.00 for a functioning hard drive, that you stated would allow me to "[a]ccess files from any networked PC or Mac for easy file sharing, or any system online" in your eBay listing. That is what we call a merchant warranty in the legal business. There is another issue you may not be aware of under the UCC, which is that if you are a merchant, meaning a regular dealer in goods of the type sold, you are also responsible for consequential damages that result from shipping products that violate the implied warranty of merchantability. Besides legal action, you should be under no illusion that everything that transpires between us cannot be publicly disclosed in the feedback I leave you because of the character limit. You may want to learn about tinyurl. I cannot in good conscience leave you positive feedback, because you should have taken the drive back immediately. I can leave you other than negative feedback only if you return me to the position I was in before I did business with you. THAT MEANS A FULL REFUND OF $309.00 with no deduction for the shipping costs, any YOU PAY any shipping costs to bring the drive back to you. I will gladly send you the receipts so you can verify all shipping costs. If you do not think these terms fair, I suggest you speak to an attorney. I should not be without the drive I was promised and out $100 because of your failures. You always had the choice to do the return instead of following our suggestion to deal with the manufacturer. This was the choice you made for yourself although we did not insist on it. Anyways, we will send you a shipping label in a follow up email and you can go ahead and ship it back to us. Whenever we receive the item, we will issue a prompt refund for all of it. Thanks. I paid you 309.99 for a drive that never worked. Today you refunded $276.49. The money you already sent was for me to send that drive to the manufacturer, at your behest, who FAILED TO MAKE IT WORK ON MY CONFIGURATION. A configuration YOUR EBAY AD SAID WAS SUPPORTED. If I do not have the rest of the money by 12:00 noon today I will be done dealing with you and will proceed as I have previously informed you. If you think anyone reading this chain of emails will believe that was your intention, you are also mistaken. If it was, you would have apologized instead of calling me "a person of no patience."
