I was involved in a accident back in June 2010. It was the other persons fault and the car was not driveable. I found out that my policy did not have roadside or rental coverage and was in a difficult situation because we don't have much money. In fact that car was the only nice thing we had.
I got on Craigslist and found an ad that claimed they would waive the deductible and provide towing and rental so I called them. They came out in a SUV and picked me up to take them to where the car was. They told me they were located at 265 E. Corporate Dr in Lewisville, Tx. They told me that they had four rentals and were able to get started ordering parts right away. A few days later they called and reached my partner while I was at work and told him the check was in and if he could go with them to State Farm and get it so they could use money to pay for parts. My partner does not have any experience or knowledge of these matters and agrees. He also Gave them the entire amount (over $7100.00). The other persons insurance covered rental for me since it was their fault.
A month had gone by and I began to wonder what was taking so long so I called and they told me that the parts were special orders and it was taking longer but not to worry. Then another month goes by and the body shop calls and tells us State Farm wants us to return the rental. They told us that all of theirs were out and it would be a couple days to get one for us. A couple days go by and still no rental. We were very angry and virtually trapped. A good friend had a very old car in their fathers garage they could loan us but this car is on its last leg. It leaks oil and gas and has no air conditioning. Of course, we accepted or we would have no way to work
I had a bad feeling and wanted to see the car and started going through the insurance paperwork and noticed that the address listed on the papers was not the same one they told me. I immediately drove to the address and my car was not there. I threatened to call the police if the man didn't tell me where it was. This place is called Starvin' Marvin's. It is a paint repair place and a real dump. Marvin acted as if he had nothing to do with this at all and really didnt help at all except to tell us that our car was at a frame shop a couple blocks away. We saw it and it was still a mess. The Lewisville Police were no help either and told us that a report wasnt necessary.
I begin doing more research and come to find that these guys (Paul and JR Stevens) do not own a shop and are contracting work from other business with our car without our consent. They have several different cell phone numbers and business names they work under and no physical address. We tried patience and being calm and all they have done call and lie saying they were just having the frame worked on over the next few months.
I had called a few attorneys and the ones that could help were completely out of our affordability but I had a friend that knew one and I saw him. He had a friend that owned a body shop and put me in touch with him and I was advised to have the car removed so he could look at it and he would pay the tow fee so I did. Later that day he called and told us that the only thing they did was put a used red left fender and a white used hood and bolt them on and that nothing else had been done at all.
We are devastated by this. We still make payments on this car and there is no way we will ever be able to come up with the money to fix it. We have no idea how to even locate these guys because they only spuratically go to Starvin Marvins and he doesnt tell us much. We know certain places we could look but we don't have extra gas money to run around everywhere and wouldn't know what to do if we did locate them. |
