The crime being committed is the misuse of public information by Search Engine Optimisation companies to actively benefit from extortion of american citizens.

(c) A person commits an offense if, with intent to obtain a benefit or with intent to harm or defraud another, he solicits or receives from a public servant information that:(1) the public servant has access to by means of his office or employment; and(2) has not been made public.

what about when the person in the arrest record isn't even you? My husband had his identity stolen, and the piece of crap had multiple arrests in Florida under his name...he has proven with the state of FL that it's not him, but for some reason they won't change the name on the arrest record...and when you do a Google search on his name, there this guy is on mugshots.com, 1st two results. With my husband's name. And he bears enough of a passing resemblence to my husband that those who don't know him well might think that it is him, when he was younger. He's now in business for himself, and anyone who wants to contract with him that decides to do a Google search would certainly not hire him...the piece of crap who used his name was a serious criminal...even escaped from jail, and has swastika tattoos. It seems unfair that we'd have to pay to have this corrected.

I would like to join in a class action suit..I have been following the conversation. I am not happy with the satae of Florida's answers, a lawyer's answers. People are afraid to make a test case and the internet seems to have cart blonch, with the first amendment and "public information...They are privately owned business and not a municipality..The continued linking of name and information, to dropped, nolle, expunged cases is now the other side, which is fraud, extortion, liable, publishing with out permission, evading contact with public to resolve matters.. Publ;ic information that is out dated, trumps a persons civil rights?

I would like to join in a class action lawsuit if possible. I have my own mugshot plaster on Google since 2004! My case was dismissed- never went to court! This kind of defamation has cause a false representation of who I am and it is an intentional infliction of emotion distress. I am currently completing my master in college and want to turn my life around but I have lost positions and job opportunities due to mugshots.

I am not happy about a company using past mistakes and making it easier for other to access which has cause potential job loses, opportunities and has hurt my relationships with others. That is how I found out about Mugshots.com, Florida.Arrest.Org and such. On top of this, I have to pay money to remove for content that was published without my knowledge nor consent which I find it deplorable.

Within seven years, I have been trying to turn my life around by removing myself from negative association, pursuing college and a career but I can't with my mugshots on the website.

We live in a tough job market and this is the last thing I need to worry about.

The scam-industry premise is: “on-going-torture-by-extortion” & is reprehensibly disgusting. Abysmal police/justice management of sensitive information. If pigs/justice are not taking kick-backs by allowing extortionists access to mug-shot information, they should be fired for their information mismanagement & being accessory to allowing criminal extortion. Innocence after arrest, paying a lawyer to “clear your name” now has no meaning. The idea of “innocent until proven guilty” has long been a joke of the US justice system. People awaiting trial can spend years in prison; Now allow those free on bail or declared innocent to suffer at the hands of public for being unfortunate enough to be introduced to a broken police arrest, booking process, and its information management. Now extortionists can make money by tormenting all involved in a police arrest information mis-management process.

Extortionists (inclusive of *.arrests.org, *.mugshot.* & those in supposedly privileged positions to remove info at a cost are extortionist leaches and need to be imprisoned.

Getting arrest information off the internet is not a legal effort or a costly one. It REQUIRES the author to remove the information and ideally be prevented from getting it in the first place. It requires police/justice to take accountability for ensuring such information is restricted to “only those that need to know” within the justice & police systems. Any money made in allowing a ‘transparent legal process’ needs to be weighed against the cost of tormenting victims = EXTORTION.

I may have a better suggestion, get even, fight fire with fire. If it is legal to publish factual information, then informing people that a minor misstep or wrongful arrest can get you a life sentence of public shame is also legal. Then maybe we can convince people to retire/vacation elsewhere. Set up websites that show up every time some one scroogles a Fl. vacation or retirement related activity, informing them of Florida's liberal information policies and the consequences. When the (tax) dollars go elsewhere we may get someone's attention. These mugshot rackets will only stop if the law is changed or if the profitability is taken out, don't pay them if you can! Whatever you do, keep it legal, don't give lawmakers reason to come up with more stupid stuff, they've done enough damage as it is.

The legal issue here is not privacy, it's consumer protection. People affected by this need to contact their state attorney general's office, in the consumer protection division, and the Federal Trade Commission. File a written complaint and follow up by telephone.

For anyone that is has ran into this problem please contact me. I found a lawyer who is willing to start a class action lawsuit against these sites. If you have your mugshot on one site, chances are it's on several sites. I too have the same problem. Please contact me so we can start this asap. Called mugshots.com the past three days in a row and it's the same person answering the phone all day every single day..Place is a joke. When you have your record expunged it's supposed to be sealed and not available to the public. I get arrested one time in my entire life in the great old state of Florida for less than a gram of marijuana and I get a spot on this website. Bunch of bs after spending almost 2000$ to have it dropped and expunged. Any other state would have just taken the marijuana.
