my home address along with the mugshot is now on the front page of google search as soon as my name is searched it pops up. this is the most illegal thing I have ever had happen to me, and is absolute invasion of privacy and extortion I demand this resolved< please help!

| I'm hiring an attorney next week if my picture is not taken down as I requested to the contact e-mail on florida.arrests.org. I've also called removeslander.com and spoke with "Phillip" who gave me information about getting it removed for $399. Obviously I am not paying them to do this as I don't trust this business. To the person who wrote the 93 page report, I'm curious as to why you went to the effort of that work and did not go after them legally? |

Funny how when I search "Florida.arrests.org" that removeslander.com doesn't show up anymore. Trust me when I say that I will hire an attorney and pursue both removeslander.com (and other names it goes by) along with florida.arrests.org. Somebody needs to do research the owners behind the websites. |

| I want to post an update: They will remove the picture if asked nicely. You can pay 14.95 to get it removed quicker. I'm not a fan of this "business" and not sure of the legalities behind it, but they do comply when asked to. |

| Florida.arrests.org is linked in with bustedmugshots.com and mugshots.com ...they are all extortionists and will cyber harass and slander anyone they think has money. They are making money through their scummy low life extortion racket. It is against Florida law to use mugshots to defame, slander or cyber bully people and that's what they do. If you pay them to remove your mugshot from their website then you are helping them to continue in their racket. The Florida States Attorney is looking into this. Information is being collected from all their posts and links in various social media websites. They better stop before they are the ones who will have the mug shots and get a lawsuit to deal with. |

Someone needs to set the record straight since most if not all of you are so clueless about this area of the law. None of these companies is so called "extortionists". They *republish* material that's originally published by the local county. What they publish is FACTUAL regardless of the result of the arrest. There's no slander, there's no libel, there's no harassment. If you're familiar with The White Pages, what they do is add all locals who reside in an area to their book and if a person doesn't want to be included, they charge to be excluded. That's a business model, not a crime. You may not like what they do and that's your right, but calling them "scammers" and "extortionists" is a weak and false argument..
If you want to take your anger at someone, my suggestion to talk to whoever published the information in the first place - the government. |

The government doesn't index their arrest records by a person's name on google, because they're florida records and doing so would create a federal issue. These companies are profiting off of public information through extortion and violation of federal privacy laws. Keep an eye on wired.com this week, then come back and tell me it isn't extortion ;) |

Let's see.
1. Google indeed spiders gov. sites. Spidering isn't a legal issue.
2. These companies profit off of data just like other media company profit off of such data. Media from advertising during coverage, or trademarks, public housing data, and others which publish private records including names and locations of inventors and attorneys.
3. Your extortion claim won't hold water one day in court. The arrestee doesn't own that data, the government does. It's not the arrestee's data to begin with. |

The only reason the extortion claim would be "iffy" is because no precedent has been set in regards to who has ownership over one's online profile. This is an issue currently being litigated.
However; these mugshot site's don't just consolidate information. They allow "comments" to be posted on a person's information, which does in fact amount to harassment. The extortion claim would further be strengthened if florida.arrests.org charges money in order to remove the information.. that's a completely different animal from simply collecting ad revenue. If a link between crunchline llc, and the companies that claim to use lawyers in order to remove the information (doubtful as the information typically gets removed in less than 24 hours) is found, it's curtains.
You can't take someone's public arrest record, or any other public information... and then threaten to publish it on a far reaching medium unless someone pays you in order not to do so. That is extortion and a violation of federal privacy laws. Period. Just because Crunchline llc uses SEO instead of a newspaper, doesn't change the definition. |

That's not what they do. They actually publish the information and don't approach anyone about it prior to publishing. If someone wants, they approach after the information is published and then they charge for exclusion if that person is interested. It's a proven and legit business model, like the White Pages.

Crawling / indexing / spidering in itself isn't an issue. you are correct.
Google isn't liable. What is at issue is who has the authority to allow google to crawl someone's name. You're supposed to place bot scripts around personally identifiable information. Look up us code § 552.
"To the extent required to prevent a clearly unwarranted invasion of personal privacy, an agency may delete identifying details when it makes available or publishes an opinion, statement of policy, interpretation, staff manual, instruction, or copies of records referred to in subparagraph (D)"
Just because you are arrested, doesn't give the government, or anyone else, ownership over your name. You can't legally index a person's name on a national medium without permission of that individual. Why on earth do you think Encyclopedia Dramatica was taken down?
You have to ask the person's permission first... then that person has the right to charge you to be able to publish it.. not the other way around.
Furthermore, US code clearly states what isn't acceptable in terms of publishing information out of public record:
(7) records or information compiled for law enforcement purposes, but only to the extent that the production of such law enforcement records or information
(A) could reasonably be expected to interfere with enforcement proceedings,
(B) would deprive a person of a right to a fair trial or an impartial adjudication,
(C) could reasonably be expected to constitute an unwarranted invasion of personal privacy,
(D) could reasonably be expected to disclose the identity of a confidential source, including a State, local, or foreign agency or authority or any private institution which furnished information on a confidential basis, and, in the case of a record or information compiled by criminal law enforcement authority in the course of a criminal investigation or by an agency conducting a lawful national security intelligence investigation, information furnished by a confidential source,
(E) would disclose techniques and procedures for law enforcement investigations or prosecutions, or would disclose guidelines for law enforcement investigations or prosecutions if such disclosure could reasonably be expected to risk circumvention of the law, or
(F) could reasonably be expected to endanger the life or physical safety of any individual;
This site is clearly in violation, and has put itself in a pretty bad position. |
