Refinancing a construction loan for the home we had dreamed and built together in 2007, my husband had obtained a Government Farm Loan/Rural Development Loan through the USDA. We had secured the original loan with a down payment of some $25,000.00, and it was every cent our new found family had saved up so hard for. Not long after we had closed on the property, the loan had been sold and has since been handled by Chase Home Finance.
In August 2009 after my husband had been temporarily laid off from his job; meanwhile, myself going through a troubling pregnancy, we found ourselves a payment or two behind on our mortgage. After getting assistance from a state agency on our August pmt., we were offered and enticed by Chase to apply for the Home Modification Plan, which had fit our temporary financial hardship perfectly.
After being told the same tall tale of not making payments for the 3 months it would take to complete the mod process or so called "forbearance". I jumped through hoop after hoop, sent document after document and complied with every request from Chase for a couple months. Oct 2009 I received a call fromthe negotiator telling me we had INDEED qualified for a modification trial and had verbally promised me a lower interest rate and payment amount to start Dec 1 2009. All we had to do was wait for the packet to come Fed-Ex within the next two weeks, have it notarized within 72 hrs, send it back, and we were all set.
Needless to say the packet NEVER came! I called and called and called. I have documented phone calls, faxes, and e-mails tracking this paper work necessary for my modification. Dec. passed, then Jan., Feb., and half of March. I was told the same story every 76 times I had called, it must have been lost, we cant take a pmt until the paperwork is complete but don't worry, everything is fine!!!
As months passed and mortgage payments were being declined, I grew very concerned and contacted the HOPE hotline for help. The first three way conference call with them Chase had told me the same story. "It's lost, were sorry, everything will be fine". After calling back 72 hrs later as instructed by Chase, me and the counselor were shocked to hear that we indeed had no modification and in fact we were in foreclosure for non payment and they had no clue where I ever had come up with the idea of a forbearance. I was $10,456.00 delinquent and they needed their money. After another long span of months and calling Chase, each time contacting them with HOPE counselors, only to be told lie after lie after lie about the disappearing modification and forbearance and how I was going to be able to keep my home.
Another 7 months have passed as it's now Jan 2011. 156 faxed documents to Chase, 7 COMPLETED RMA application packets, two which were returned to them Fed-Ex overnight and still no modification trial. The last stack of returned -requested documents and even verified by Chase themselves were not recent enough and had a page missing. It seems so odd however; every time its beneficial to Chase in some way, their seems to be a document missing, lost, or incomplete. GO FIGURE!!! We are currently in foreclosure status yet again today.
I am so confused about why and how Chase has in sort been "ALLOWED" to misuse and misrepresent such government programs and modifications guidelines and on a United States of Agricultural loan to boot. So if Chase cant/wont help me, HOPE affiliates cant/wont help me, and their is no laws too help, it seems I have no other choice but to jump through Chases commands, up until the day they take my home we have worked so hard to build our family right out from under us.
