Our company contract Mr. Cullen and Alternative Debt Solutions for debt settlement radio ads in March 2011. He initially contacted us, and played a radio advertisment that we deemed acceptable by LHDR and TSR rules. He provided a login to drmediatracker.com to listen to and return calls. We wired money to his bank: TD Bank based in East Northport, NY, account 7923769231, routing 026013673, on two ocassions, in the total amount of $4600 each, $9200 total. Our original order on 3/16 was for 100 calls per week of 3/21-3/25. I placed a second order on 4/5 for 100 calls per week of 4/11-4/15. To date, we have answered 96 calls, well short of the 200 we have ordered. The order was for 30 calls per day; clearly that has not occurred. Our call times are very short on the radio spot. When we call people back that are hang up calls, they have dialed a wrong number. We have not gotten much of anything that is a quality call, or anything over $10k, more or less, much that is workable. I emailed Mr. Cullen on 4/12 regarding our number getting called for a live transfer, to which I expected a call back from Mr. Cullen's IT department, and all I got was an email stating our IT department is looking into it. I have given Mr. Cullen plenty of opportunity for the calls to really start flowing in, as he indicated they would. A few hang-ups here are there are understandable, but every single call being a wrong number or hang up is not. The terms of the insertion order agreement for call for 100 calls per week, the volume has not been met. I have seen no effort to insure we get calls that have been paid for. 100 calls in 30 days is not CLOSE to 200 calls in 30 days that were ordered. Last week ALONE, we are to have received 100 calls, and received 31. I have returned over 30 calls for hangup/wrong number. I emailed Mr. Cullen on 4/18, requested an easy resolution to this. I proposed two solutions:
1. Deliver QUALITY and VOLUME requested, in full, by this Friday, 4/23.
2. Refund for the difference of 104 calls not received. Refund for 104 calls, due by 5/2/2011. 104 calls x $46 per call is a total of $4784. Mr. Cullen's immediate email return to us was as follows:
I just listened to a handful of calls. First you received 44 calls. Second when you have an interested consumer you guys either taking there info and calling them back or you agents are rushing them off the phone. I responded, and he responded with an invoice. Calls and emails have gone unanswered since 4/18. Do not purchase leads from this individual. We intend to file papers with the New York State Attorney General, the BBB, local Chamber of Commerce, and our attorneys are contacting him for breach of contract. |
