This letter is written as a complaint in regards to Wholesale Resort Services (WRS) 8961 W Sahara Ave STE 102, Las Vegas NV 89117 for failure to provide services and live up to the contract.
On 22 June 2011, my wife and I attended a presentation by WRS for the transfer of our timeshare at L Welk Desert Oasis. We signed a Timeshare Trade-in Agreement, see attachment 1. We agreed to give to WRS our timeshare valued about $12000, free of charge and gave them via American Express charge, $495.00 to pay for closing costs. They told us there would be no other charges and that the transfer would take place before the end of the year so that I would not have to pay the L Welk maintenance fee for 2011. The contract states closing costs $495 (WRS told us this was a recording fee), processing fee $0, and balance due $0. It says seller pays more fees as required but WRS waived that. Starting in Aug 2011, I started calling WRS once a month to find out the status of the transfer. The clerk assigned was Debbie, and she said she was waiting for the transfer forms to arrive from L Welk in California. I called L Welk to help expedite the required forms. End of Oct, Debbie called to have us come in to sign the new forms. At that time she and Mike Gallagher, part owner of WRS, said that we owed an additional $396.00 for the closing costs, and the transfer would not continue until we paid. I reminded him that the original agreement was that we would not have any more costs. He then agreed to pay the additional fees. In Dec, I called and found out that Debbie was fired and a new person Sharon was trying to sort out the file. Also in Dec, I received notice from L Welk that maintenance fees were due, Talked to Mike and he said WRS would not pay. I then paid L Welk the $708.00 maintenance fee, and RCI renewal fee of $299.
On Jan 18,2012 we were called in to sign new forms that Sharon had filled out. She said she would send the forms out as soon as Mike cut a check to L Welk. On 24 Feb, Sharon was still waiting for check. I then called Jason Potani, head of Customer services, to help in expediting the transfer process since Mike Gallagher would not take my calls or call me back. Jason said he would try. On March 9, 2012 I talked to Sharon and she said that an additional fee of $600.00 would be required from me before proceeding. After several emails back and forth between Mike and I, he said discussion is over, pay the $600.00 or the process stops, he would not record the transfer or return the fee.
In light of the above troubles, I checked the internet and discovered a website called Scam Informer, www.scaminformer.com. There are many unhappy people who felt bilked by WRS. We regret not finding this website before our encounter with WRS.
We feel that WRS is a scam operation. They did not record our timeshare with the proper court system, and render us a successful transfer. |
