I found an ad that read "$0 down. 2.5% interest rate. Bad credit ok." Skeptical, though in need of a new home after a divorce that left my credit less than perfect, I called and spoke with Peggy. She informed me that I would have to take a class 4 hours away and that the loan program was only for new homes using themselves as the builder. I decided to go to the class as I had nothing to lose. Upon returning from class I learned that the loan is a typical mortgage and the rate was so low because the builder was going to buy it down from the current market rate and roll that sum into my loan with them. I was excited about building a home for my daughters and I, so I agreed to allow Vasta Development to have me pre-approved for the loan. She required $1,000 in earnest money and had me sign a document stating that I had three days from speaking to the loan officer to cancel the contract. The loan officer informed me that the loan would take a minimum of 4 months to complete. I gave Vasta my deposit on March 28th. 10 days later my father suffered a heart attack and a massive stroke. I emailed Peggy at Vasta as I realized the mass expenses my family and I would incur due to this loss (in home care, medications, ect) I told Peggy that with deep regret, I would not be able to begin building as I was unsure where I would be in a year (my father resides in GA and I live in FL). Peggy asked me to send a letter from the hospital, a phone number to contact his nurse/doctor, and his name. I gathered these documents and sent them to Peggy. She told me that these documents were not enough and she would need his medical records and the doctors phone number and a letter explaining his condition. I explained to her that the hipaa laws protected him from her gathering his personal medical records and in his current state, I could not grant her this request, however, I had given her what I was able to provide. In my most recent conversations with her she told me she would not be refunding the earnest money of $1,000 to me and hung up the phone (although no costs were incurred by Vasta, I had not even met with the builder at this point to choose a house plan) Warning to all who are looking to build on the panhandle - Do not do business with this company. The homes are too expensive $125/sqft for builders grade material (laminate flooring throughout the home, ect) and they are not willing to work with you no matter your situation. I have managed to secure my father into a home that will be able to accommodate his condition and help him better than I could. I will be purchasing a home on the Panhandle, and WILL NOT be using Vasta Development as they are thiefs and liars.

Anonymous accusations by unscrupulous consumers are the act of cowards and cheats. The real victims are legitimate companies being targeted in unwarranted smear campaigns, because so called “consumer protection” blogs provide malicious charlatans a voice without legal or moral accountability. And, then for a fee these very same websites provide “reputation repair” services to the injured parties. In other words, these vultures openly encourage the posting of false and deceptive information to profit from the unjustified defamation of honest businesses.

Here are the facts; the author of this unsubstantiated attack is Ms. Juli Nielsen of Farm Rd. in Panama City, Florida. She came to us, because Vasta Development represents a non-profit lender that specializes in low interest mortgages to moderate and middle income households and the borrowers do not need perfect credit or substantial savings to qualify. She employed our services and signed a performance contract that required a $1, 000 deposit. Unlike credit based lending our mortgage process takes an average of four months to complete and we only get paid when we build a house. Therefore, the deposit ensures the buyers commitment to the program before we obligate our manpower and resources. The deposit was refundable up to three days after her consultation with our lender, at which time she learned exactly what was required for her to receive final loan approval. By Ms. Nielsen’s own admission she cancelled the contract thirteen (13) days after the refund period had expired; confirming that Vasta Development was under no obligation to return the deposit. However, we agreed to return the money as soon as she provided verifiable confirmation of her father’s illness. All she had to do was supply a signed letter from a hospital administrator and the attending physician on official letterhead. What we received was a brief two line narrative that did not come from the hospital or a doctor. The document was unsigned and did not support Ms. Nielsen’s account of where her father was being treated or his condition. We made repeated requests for the necessary documentation but she refused accusing us of violating medical privacy laws. To address her privacy concern; we contacted the hospital where her father was supposed to be admitted and confirmed they would release the information with patient authorization, but no one by that name had been admitted.

We did everything humanly and ethically possible to accommodate Ms. Nielsen. However, based on her lack of accuracy and unwillingness to substantiate her claim; we can only conclude she lied about her hardship to deliberately circumvent Vasta Development after we had shared our source of financing and gotten her qualified for a 2.5% - no down payment mortgage. The evidence of this comes from her own complaint narrative; the reason for cancelling the contract was the unexpected responsibility of caring for her ailing father in Georgia, who had just suffered a stroke and a heart attack. We were sympathetic to her family emergency and agreed to return the deposit upon receipt of legitimate proof. We didn’t ask for copies of medical records or privileged information just a letter of confirmation from the doctor. What parent wouldn’t agree to provide a statement clarifying his medical condition and that his only daughter was moving back home to care for him, knowing it would ensure the return of her deposit? Then we discovered the truth, she was not burdened with the care and custody of her father and plans to buy a house in the Florida Panhandle, but not from us. Within two days of exposing her deception she was posting her unfounded vitriol on internet sites, like this one, that do not verify the validity of consumer complaints.

Juli Nielsen is a pathological liar who was caught in the web of her own subterfuge. She had no intention of leaving the state and used her father’s illness, which we cannot verify, as a ploy to cancel our contract and receive a refund under false pretenses.
