The company provided negligent auto servicing and made deliberate false statements to me. Based on their web advertisement they were retained to perform a full oil change and lube. I specifically requested that the completed job be personally inspected by the Manager, Andy Card, to check for post servicing oil leaks etc. since the next part of my trip involved back country off-road driving and an oil leak would be expensive and possibly dangerous. Card agreed and he provided assurances to me upon complation of the job that his inspection was in fact performed. However the very next day - and hundreds of miles from Moab - I accidently discovered that there was in fact an engine oil leak. Many hours of my time were required to locate - in an unfamiliar city - a qualified local firm to undertake problem analysis/repair on an unscheduled, emergency basis. The professional firm I found/employed provided a written affidavit attesting to the negligent Lube-It Express servicing responsible for the oil leak. I then complained directly to the company - Thayn Enterprises/Lube-It Express - in writing several times but they ignored my letters. Finally Thayn responded to my third letter with a discussion of his experience with consumer scams and further made excessive demands for incident information. It became clear that Thayn was stonewalling and obstructing the process apparently in the belief that a senior citizen, thousands of miles from home, could not afford to proceed and accordingly would drop the well-justified complaint if he- Thayn - made the process sufficiently onerous and costly. I have tried for many months to resolve this problem but Thayn has refused to make a fair settlement offer for all the costs I incurred as a result of his negligent work. Thayn and his paid agents have engaged in ad hominem attacks against me and has employed other disreputable techniques to avoid his responsibilities. While the case is not yet being litigated I have concluded that Thayn has no intention to make a fair settlement offer and accordingly that formal complaints will be required to obtain just treatment. |
