Fraud, embezzlement, & theft by SunTrust Mortgage with regards to a Flood Insurance Policy insured through QBE Insurance:


Since October of 2010, I have been receiving letters from Sun Trust that my property was not insured to include the flood insurance required as of the Flood Disaster Protection Act. I have contacted my insurance company and they assured me the policy covered the requirements and I asked for a copy of this policy to send to Sun Trust. I called and the told me to fax this to them and so I did. Two weeks later I received another letter stating the exact same thing, so this time I had my insurance company send them the required policy.


On November 30, Ireceived a letter stating that Sun Trust purchased a policy through QBE Insurancefor $2,250.00 I immediately called Sun Trust Insurance division and spoke to Odette who assured me they did receive a copy of my insurance policy and thatthis QBE Insurance would be cancelled.


On December 17, 2010, I received in the mail a Policy for Flood Insurance purchased through QBE Insurance in the amount of $2,250.00.


On Dec 18, 2010, Sun Trust had taken out of my escrow$2,250.00 for this policy.


On Dec 20,2010, I have spoken to Sun Trust and they said it was a mistake and the money was going to be credited back to my escrow and I would receive a letter in a few days. I requested a copy to be faxed tome and they said they could not do this. I told Sun Trust this wasbasically fraud and or embezzlement, and I never authorized this insurance company to withdraw from my escrow account. Iexplained to the representative that I have documented every phone call and every fax that was sent proving my insurance policy was in place.


I am outraged with this!

Tips in dealing with Sun Trust and QBE insurance. First of all yes, it is a fraud. QBE insurance is sun trust mortgage, NOT an Insurance company. I have been dealing with this harrassment for the last 2 yrs. Basically sun trust is required by law to prove flood insurance coverage(FEMA). So they over double charge for QBE insurance in order to make money. Here is what you need to do. Purchase your own Flood insurance through FEMA you should do this in january (so that their is proof that YOU paid, not suntrust) You can buy it with your credit card, but I had to go into my State Farm agent to pay, because FEMA does not take payments over the phone-you have to be an autherised agent to pay online with credit card. Next you will recieve harrasing mail from suntrust some time early May. You will get 2 letters the first will be a 90 day binder from QBE insurance ( this ammount will be over double what you actually paid to FEMA) And the next will be An Annual Escrow Account Disclosure statement- This will say that your monthley payment is going up (mine was a $200.00 increase) Stay calm, and breathe. If YOU actually payed FEMA you can prove it. First I took all the letters to my State Farm agent. She was more than happy to fax over proof of payment and MY declorations page from FEMA She even called them to make sure my papers were in order. THANK YOU SANDY and JAQUIE-your the best. Next I had to deal preventing my payment from going up. Sun Trust will send you a letter saying you have a escrow shortage (you really dont, they just thought they could charge you for that insurance) OK, but it is all a big game, thay want us confused-so you have to pay th shortage- but then they will turn around and send you some money back-like I said its a game. Next you have to call Sun Trust and speak to a supervisor in the escrow departmet. I spoke to some one else, and they told me what I wanted to hear-but later when I referenced that conversation (I got their name) to a supervisor they said that that person was mis-informed. So always ask for a Supervisor. Tell the supervisor that YOU paid the FEMA insurance and you need the escrow account re-evaluated. If they dont hve your paperwork yet, ask for the fax number and send it STAT. When they realise that YOU DID PAY- your payment will stay the same, or increase silghtly. If you didnot pay FEMA directley get to a state farm agent NOW- you may still have time since the increase doesnt start untill 7/1. Hope this helps, stay strong :)

We are in the same boat. We paid our own flood insurance and Yet Suntrust said it was not enough. Every time we went to pay our mortgage they accepted the check but didn't apply it to our account because we were not paying anything into the escrow they opened for flood insurance. A couple of months later we would receive a check for the amount we were paying on our mortgage. After around three months of this they thought it was fixed but wait for it...It happened again. We had more flood than we needed and even paid a surveyor to come survey the property. This has been going on for almost a year. We keep going in circles with them. Today we received a letter that our home is being forclosed on after the first of the year. Suntrust said that it is all a mistake. When they tried to get it taken off our credit THEY FROZE OUR ACCOUNT FOR FRAUD!!! Called again and they say they don't know what is going on and NOBODY can figure it out. WE are so screwed.
