| In February I received a notice that I had evaded paying a $4.50 toll on the South Bay Expressway on 1/27/11. Thinking that maybe I had unknowingly missed a toll and having gone to OC the month before I paid it plus a $60.00 penalty. I just received a notice that again I evaded paying a $3.00 toll on the South Bay Expressway. This time I checked the time and date and know for sure I was not even driving during the supposed time of infraction. I then decided to look up where the South Bay Expressway is. It turns out it is a freeway going to Mexico where I have never been. I am filing a request for an administrative review but don't hold much hope of winning and certainly not getting my $64.50 back for paying the first fraudulent citation |

I bought a newer used Chrysler van at North County Ford in Vista to replace my old 2003 Dodge Grand Caravan and ended up selling my old van to them for a $1K trade in value. This was on 5/08/2011. The used van wasn't completely ready so I drove the old one for two additional days and surrended it on 5/10/2011 and the original paperwork I signed on 05/08/2011 included a Release of Liability form that I signed and was mailed in by the dealership.
Somewhere around June 26, I received a notice of toll evasion and payment request from South Bay Expressway and was perplexed as to why I was still being listed as the registered owner of the vehicle when I had sold it to North County Ford on 5/08/11. Then I got two more notices for two more toll evasions when, in fac, t I have never even been down in that area.
I swung into action and secured another release of liability form from the dealership and delivered it in person to the DMV in Oceanside and made sure the young lady entered it into the DMV records and when I asked her if the original form had been received in Sacramento she said no and that sometimes they get lost in the mail. That really takes the cake when the DMV starts blaming their own ineptitude on the USPS!
I had her make me two copies of the Release Of Liability form she stamped with the date of the 29th of June and with the DMV designation on it.
The person who purchased my old van from a third party that bought it from North County Ford, is now blowing through the toll booth almost daily. I was told on the phone today that there are a total of 12 violations so far and I have determined to take all of the paperwork I have as well as the subsequent transaction paperwork that documents who bought the vehicle from Nort County Ford down to the South Bay Expressway office and if this matter has ANY difficulty arriving at timely resolution I will take the paperwork to the staff at Congressman Daryl Issa's office which is about 3/4's of a mile from where I live.
These are the types of matters that Congressman Issa and his capable staff relish digging into. |
