This letter we sent to SJ Lippert Flooring outlines our issue with this company: On 4/12/2010, I entered into a contract with you (Lippert Flooring) for the installment of carpeting in five rooms and the upstairs hallway and stairs. The contract also included laminate flooring in the kitchen, dining room, front foyer area, and the small foyer leading into the family room. The contractual agreement (see attached) included a warranty (above the manufacturers warranty) for a period of one year from the completion of the installation. In exchange, we agreed to pay you a total of $5,240.56 of which you have received the total amount.
Since the completion of your work, we have discovered issues with both areas of the project and despite repeated attempts to have them corrected, we have been only met with resistance, fault finding, stalling and other tactics to avoid responsibility for providing us with a satisfactory service and product in accordance to the contractual agreement.
Within 30 days of completion and our actual occupying the house, we contacted you regarding the carpeting and the discovery that along most of the edges and one the steps, we were experiencing pricks in the bottom of our feet. It was explained to you at that time that we had a toddler and was concerned about her safety as she was crawling and learning how to walk and we did not want her to be injured. You stated that was the tack strips needed to hold the carpeting down and that you would send some one over to take care of it. To this date, almost a year later, no one has ever come to our home to resolve the issue. You son, Tim, contacted my fiance, Gordon and once it was explained to him what the situation was, he was told by your employee that all he (Gordon) needed to do was take a hammer and go along the wall and hammer them in place. While we thought this was extremely unprofessional and inappropriate that an employee of your company would make that statement, we were concerned about the safety of our daughter and Gordon spent the time crawling around the house finishing a job that was the responsibility of the company we had contracted withLippert Flooring. To this day, we still find areas on our carpeting where the tack strip still pokes thru and since you have not shown a willingness to correct this, we have had to continually address this issue ourselves. Approximately six months after the completion of the project, we started to notice issues with our laminate flooring. We have since learned that what we were noticing was an issue called peaking. When you were first contacted by my finance you directed him to call your office and set up a work order on the issue. He immediately called your office and spoke with Debbie. He was assured at the time that someone would be out to look at the problem. Six weeks passed and we had not received any contact from you, your office, or any agent authorized to work on your behalf. Again, you were contacted and a message was left. After repeated attempts by myself and Gordon, you finally returned our call and an appointment was set for you to look at the issue.
When you arrived, you acknowledged the peaking issue and in fact, pointed out that ALL the areas where the laminate was installed was showing peaking. You asked and we assured you at the time that there had been no flooding or water related issues in the house since the installation. We also explained that the floor was only cleaned with products that were specifically labeled for laminate flooring.
At that point you stated you needed a manufactures rep to come out. This took another six weeks, and repeated calling on our part, just to get someone out. Once the rep came out (January 2011) and performed what has been since identified as an incomplete and inadequate inspection, we were told we needed to wait two weeks to receive the outcome of his report. Six weeks later, and again no contact from you or your company, we contacted the manufacture (Armstrong) directly and was told you were attempting to file a claim for defective materials. That claim was rejected by Armstrong and its agents and we were told the responsibility remained with the flooring contracter-Lippert Flooring.
Since that time, you acknowledged that T-molding should have been originally installed to allow for expansion. It was not and you installed the molding in two different areas in an attempt to alleviate the peaking. While this helped show an improvement in some areas, it did not resolve the peaking issue. Gordon contacted and explained the issue to you. At that time, you agreed to meet with him on a Monday, March 28, 2011. When you did not call or show up, Gordon called you and you were extremely rude to him and told him he needed to wait for you call and then you hung up on him. You have yet to contact him or myself regarding this matter.
