Credit Acceptance, Michigan n/a Refusal so produce Lien Release Detroit, Michigan |

In 2009 I had applied for a car loan with a local dealership, they at first were going to fiance it through credit acceptance, my credit score was not so hot as this time, so I expected no less. I had my payments set up, and they were put as the lien holder on the title. About two weeks after this arrangement was signed and finalized, I get a notification from the finance manager at this local dealership that the loan did not go through and the dealership would take over as the lien holder and I should pay them directly. Fast Forward to 2011, the car is paid off, I've been paying this local dealership directly and saved every receipt from every payment. Also the lien release from the dealership. The car is parked outside of my house and it is hit while parked, hit hard enough to total it. I had an old title that listed credit acceptance and the lien holder, took it to my county clerk's office with the lien release from the dealership, however, I come to find out that Credit Acceptance is still listed as the active Lien holder. I call them, and at first I get their call center, and while their associates try to help, they are in a call center and must e-mail everything to anyone that can actually accomplish business tasks. So I call the car dealership, and they give me the corporate number for CAC, come to find out, this dealership never followed through with getting CAC off the title. I have been calling since december fifth, trying to get the proper paperwork to get them off this title. I have never paid CAC for this car, and they have no legal rights to it. They canceled this loan, however, they are still listed on my state Title as the active Lien holder. They have said they have faxed it to my county clerk's office and rattle off dates, with no confirmation number of any kind to me. I have called my county clerk's office and they are not receiving it. I was informed by the county clerks's office that if it were really faxed, they would have received it. I have called CAC corporate headquarters, and asked them to mail it as a substitute to my home address. They said it would take 7 to ten business days to process the request. They say my account is closed, and it has been since 2009. It has been more than seven to ten business days, and I have not gotten any mail from CAC, and I feel like I am either not being told the truth, or this is simply not being done. They have given me no tracking number for anything mailed, just their word, which at this point does not suffice. I call their call center, and I get this excuse "It must just be holiday mail being slow". It's not that slow. Or "I can't help the mail". I think I have been more than patient with this request as it is now approaching the new year, and they have YET to deliver this paperwork. Why can't they fed ex or send a certified letter? In their line of business, I bet they send many certified letters. I have been more than patient in waiting on this, and it is keeping me from an insurance settlement that should belong to me. CAC corporate knows it was wrecked, knows I am no fault in this accident and am due a settlement, so either I am being lied to, or someone is not doing their job. They even acknowledge that this account has been closed for two years. Very frustrating that they cannot follow through on the paperwork. I called yesterday to their corporate office and the title department said they couldn't mail it to me directly, but it was in the mail. That they had just been faxing it. But then she gave me december 12th as a date she mailed it. Their facts are not adding up, I'm getting different answers every time I call their corporate office, Something screwy is going on here. What steps can I now take to procure this lien release for a car that was never really financed through this company? They are legally bound to give me this as the loan was canceled, so why am I not receiving it? I have been more than patient with this company, and just want the documents that they legally should be sending.
