Shellco Credit Systems Ltd Threatens/Swears/Hangs-Up on College Students Concor, Ontario |

My boyfriend and I live in Peterborough and last year we were sent to collections because apparently we owe our last apartment money. We do not owe this in fact we tried to dispute why we don't owe this money and we were to speak with Fernando Ferreira and he would use threatening, profane language and intimidating pressure. As I know this is a prohibited act in regards to dealing with us under the Collection Agencies Act. Why does people get away with this? I have been told to write the company a letter but I have no idea how that will go over. As I have wrote a letter and sent it already.
This all started over that they say I did not give proper notice which we gave a proper 60 day notice and the amount they say we owe we have no idea where the number came from because we never paid that much in rent or anything. It seems like big Corporations like Realastar need poor college money i order to survive. However, We gave proper notice and still have copies of it one year later and to be fair it is not my fault if they have poor management running their apartment buildings and they loose copies or whatever.

I too had to deal with the same representative recently. My husband and I were informed 6 months after leaving our previous apartment that there were remaining monies owed. Even though we'd confirmed mulitple times with the apartment manager that there was nothing outstanding prior to our move out date.
(Also, my name was never even on the lease and it showed up on my credit!!)
We battled with everyone under the sun- from legal aid to Ministry of Consumer and Business Affairs trying to get to the bottom of this. At the end of the 18 month long battle we were informed by the ministry that the way the conduct business, as unprofessional as it is, isn't illegal.
In the same conversation though the case worker at the ministry also advised us that if we were willing to hire a personal attorney and take it to small claims it would probably get taken care of there, but we'd have to be able to prove our case with recorded calls and such.
Now it's been 2 years since I receieved that first phone call from Fernando, and I just finally made the payment to them today. Since we're trying to purchase our first home and that is the ONLY negative thing on our credit, we had to give in.

Hi Bethany and first complaintive,
I can totally empathize with you both as I have been dealing with Mr. Fernando Ferriera, or his other name Frank Ferriera. This man is something else indeed. He calls me threatening me, using profanity, bullying me. I am not intimidated by him, or his so called lawyers he claims to have legal proceedings filed against me. The man is nothing but a bully and I cannot believe that there are not laws against this type of behaviour, but I am certain that if the authorities are called because he is harrassing you with the added vulgarity, that is just cause to file a suit against him. I still would recommend consulting with an attorney and if you did not have proof of the calls that Fernando did in fact call you (try using your recording on your cell phone next time he calls), than you should demand proof in a letter why you owe that money and change your telephone number, oh and fyi, it is illegal for him to harrass you at work! I would have requested all future correspondence regarding the money you owe be sent to you by either email, or in the mail, that way you have all the proof you need and if Mr. Ferriera did not agree to this, than the courts it is! Don't allow him, or the courts intimidate you, the courts are interested in settling this matter not bullying you. I sent him payments and the guy still had the audacity to call and yell at me asking me where my payment was...that is how organized and professional his office is. As for the first complaintive, contact the Landlord and Tenant Board at http://www.ltb.gov.on.ca or call them at: 416-645-8080. They are excellent at giving you advice and if you need legal counsel they can lead you to the right direction. Good luck to you both! |
