San Jose State University Considering Resident to Non Resident for the FEE San Jose, California

I am doing my MS in San Jose State University, CA on H4 visa with Resident FEE. In fall 2010 (Aug 24th to Dec 15th) I paid the Resident fee ($3200) and finished my semester. One week ago I got an e-mail saying I have a due of $3450 for the fall 2010.


They are saying they considered me as Non Resident for fall 2010 semester.



As per them the reason is :



On Sep 14th I submitted documents for I20 to IPS (International Programs and Services (IPS) for F1 visa from H4. I got my I20 on Sep 21st 2010. As per them they will check the Resident status on Sep 20th every year for the fall semester. They mentioned as I submitted the documents for I20 on Sep 14th and they are considering me as a Non Resident. But I got the valid F1 Visa from Dec 26th 2010. They are saying Residency is based on intention and not effective dates.Pleasehelpme in this regard.
