On July 12, 2010 Planet Mobiltiy cashed a check from our contractor in the amount of $5295 for a wheelchair lift.
On 8/5/10 a Planet Mobility Representative said the the lift was packaged and ready to be shipped.
On 8/18/10 a message was left for Planet Mobility asking for a delivery date.
On 8/26/10 Planet Mobility stated the lift will be delivered on Monday.
On 9/1/2010 Planet Mobility said they are waiting for two switches.
On 9/20/2010 Michael Woods sent an email "thank you for your willingness & extreme patients in allowing me to fulfill your order. I have stated we believe we can get the lift ready to ship in 7 to 10 days and we will be issuing a refund of $1000. for your willingess to allow me this time"
On 9/21/2010 we demanded a refund be issued.
On 9/27/2010 Michael Woods emailed "This was a custom built to order lift and can not be canceled. I believe it has already shipped or will ship in the next few days"
Referred case to State of Montana Consumer Protection
Planet Mobility replied to Office of Consumer Protection "It is a custom lift. When placed order, we notified him that he would have to check any and all regulations in regards to his state code compliance. We are not, or ever have been educated or claimed to be ont he rules and regulations of city, county, or state codes when it comes to the wheelchair lifts we distribute. The lift that was orderedc, is considered custon. Was told that custom orders cannot and will not be returned. It is also on the website. still has the lift, and now wants a refund because he did not research his state's codes, rules and regulations."
"Still has the lift" No we do not have the lift!!!!! Our money was taken and no product was delivered nor any refund issued.
State of Montana Consumer Protection forwarded the case to Mike Cox, Attorney General, Consumer Protection Division. We hope they will put a stop to this company taking advantage of the aging and people with disabilities. |
