Typically, we would not discuss a prospect's case in an open forum due to the potential-client/ law firm privilege, however, since this former prospective client already disclosed information and has made disparaging comments about me and our firm, I feel compelled to respond.

This prospective client's file was referred by another law office that was not willing to invest additional time and resources to pursue the claim. This was due to the minimal damages involved with this case as well as the claimants residence in Idaho.

I advised the claimant, that we would defer on signing him up, until which time, we had attempted recovery for the co-claimant for more than the minimal amount offered by the defendant's insurance company. If successful, we would then be hired to represent him and negotiate a higher value for him.

7 months later we, along with the co-claimant, we obtained a judgement for more than five times the original offer. At this point, the insurance company was open and willing to listen to me, and re-consider their original offer .

When I called to explain our success with his co-claimant and our intent to now get him a higher value, he eventually lost his patience and hung up during our conversation. Knowing that he was living in Idaho and unable to litigate his case in California, I decided to give him a chance and call once more.

2 days later I phoned him to discuss further and he chose not to participate or hire our firm to represent him. I then sent a letter to the insurance company advising that he never signed any documents hiring our firm to represent him and they could speak directly with him to try and conclude his case.

I feel that these comments warranted this reply. Not all customers will be happy with the outcome of their case, but in this instance, the outcome was determined by the claimant's actions, not ours.

Respectfully,

Scott Preciado
