FAMILY COURT claims they use the shared income method, but it turns out to be a double share of the obligor's income. their method is goes like this. First the guideline of PA code 1910.3 implimented an assumption cost that the child spends 30% of the time with the obligor. that 30% should always be deducted from the shared payment method. the courts say that the obligee's share is assumed to be paid. heres how they rip you off Example::: if the obligor (the payor) share income of $2000 comes to $1500 75% and the obligee (the collector) share $500 25% of the pa 1910.3 guideline is $482 according to their calculation obligor pays $361.50 and the obligee pays 121.50 but the obligee pays NOTHING. THE scam IS THIS 75% +30%= 105% Explanatory Comment—2010 PA CODE 1910.3 The basic child support schedule has been amended to reflect updated economic data. The schedule has been expanded to include all cases in which the parties’ combined net monthly income is $30,000 or less. It also reflects an increase in the Self-Support Reserve to $867, the 2008 poverty level for one person. The schedule was further adjusted to incorporate an assumption that the children spend 30% of the time with the obligor. SHOULD BE obligor pay 75%-30% (45%) of 482= 216.90 If the obligee file for spouse support or for an increase they add the support payment that the obligor IS already paying to the obligor's net income. you paid it out and its minus from your take home pay. but the next time it's CALCULATED the child support payment is added to the obligor's net income, now they are paying double. Because your take home pay is already lowered minus your first payments. take home $1500-$216.90=$1283.10 then they calculate you again at $1500 and try to slip another payment with the last amount you already paying if they file for increase. in the case of spouse support THEY take $1500 - $216.60= $1283.10 x 30=$384.93 spouse support would be $216.90 you already paying leaving you with $1283.10 +$216.90 and $384.93= 601.83 that is subtracted from $1283.10-601.83=681.27 from your 1500 net income/.............
