We had a refinance back in 2006 and in 2010 our mortgage was sold to Ocwen by our previous company, so we had NO choice in picking them, rather got STUCK with them. Hearing that the President had given banks and financial institutions monies to HELP people KEEP THEIR homes through modifications, we applied and were accepted with Ocwen. Yes they asked for a LONG application to be filled out, which by the time they got around to it was no longer valid and we had to do it again and by this time went for help through a Non-Profit org that does this kind of thing. We were accepted and all paperwork was submitted AGAIN and we got the letter of approval in the mail about 45 days after the application was filed. The terms stated that we had to pay 3 consequetive months of the new amount of $871.00 from the previous mortgage payment of $1300.00 a month. The payments had to be made ON TIME via check, money order or wire transfer. We were so happy and it was the first time we could breathe easy n a long time and my husband actually smiled for the first time in months and we were able to sleep at night thinking all was fine. We adjusted our monthly budget.....and went on with our daily lives for the next 8 months when all of a sudden my husband got a call from Ocwen stating that they were renigging on the modigication because there was a tax lien on our home. First off the tax lien was employment taxes and house taxes and were against us personally and not on the property. They had been satisfied and besides there was nothing in the contract stating that employment tax would keep us from getting a modification. Still we were paying all payments on time. We made a call to Ocwen and were told by the first person "hold on for 3 mins" and when they came back they had to hear the whole story only to transfer us to another agent who asked us to fax over the satisfaction papers which we did. After all of this, they said they wnted us to talk to the modification dept but that was by appt only and I made an appt and they called and had to go through the whole story AGAIN because she said there were no notes in the computer and they never got the fax.....(MIND YOU THE AGENT AGENT BEFORE STATED THAT WHEN THEY RECIEVE A FAX IT GOES RIGHT INTO THE COMPUTER SYSTEM) so I cornered her and said that I have proof that you got it because I sent it via fax and certified mail RRR and it was signed for and again was told "hold on for 3 mins" all of sudden they found the paperwork. Several moths later and several payments later, still being made on time, we recive a letter in the mail for fees in the amount of 14,982.00. I call up again and a different agent tells me I have the modification and that was the "reinstatement fee" but to put my mind at ease he would have talk to a modication agaent by appt again so I would feel more comfortable. On May 18th we called to make the payment and they would not take it. They verbally said that the payments now would be 1655.35 because we defaulted and I flipped out.......!!! I asked her if she knew what the word default meant because that meant we never paid anything and that I have oroof of every payment..! She said that "NO PROOF IS NECESSARY" and also there was nothing ever in writing indicating were being increased in payments so I mailed the payment of $871.00 certified mail RRR and they accepted it but they applied it to September 2010 and said the next payment due was Oct 2010 in the amount of 1655.35, which would then mean that our mortgage payment would be 2526.35 (our original mortgage payment was 1300.00), but they accepted it. Since something did not seem right to me at all, I went to the County Clerk's Office to make sure there was no lien on our property and there was NONE so I got a copy of the Deed and the lien search papers saying it is clear along with all the Warrant of Satisfaction for the emplyment tax from the city and even told them that the city tax dept said they can call and they would tell them all was fine. They said they would do that and never did....! On July 1 we recieved a paper from lawyers saying they are starting foreclosure on our home. They do not apply payments when they are sent, they string you along with paperwork to make you late and NEVER put anything in writing so as not to have a paper trail. Here are some things I have done which may help others since I have retained a lawyer and also inquired about starting a Class A suit because these are monsters and need to be stopped. I spent hours reading complaints on many websites but find it sickening that people who were basically paid to help people are so full of greed that they will push people onto the streets just for their own personal gain. First, make a coomplaint with the Federal Trade Commission (FTC), you can remain anonymous, then make a complaint with the Better Business Bureau in both your state and Florida. They are not listed because they do not have to be but can you guess why they are not? Also, lodge a complaint with your state Attorney General. Obtain a lawyer ASAP and do not attempt to do it alone it wont work. Keep a written log of every conversation you have with Ocwen, who you talked to (have them spell their name) because they will try not to give their name and when you call them ask for the previous agent you talked to. If they tell you they don't have paperwork, tell them you have the proof because you now will send everything you do with them Cert Mail RRR and then they cannot get past they dont have it.....and fax it as well. May cost extra but worth it. Also check your County Clerk Office regularly for the deed on your home and make sure they did not add their name to your deed.....they have been known to do that. Also, keep an eye on the paper for Sheriff sales to make sure your house is not listed. I am going to check into a Class A suit but I do not know how to contact all of you.
