On the Narms website there is a job opening for Demonstrators to help clients build
awareness, drive sales, and promote products. It says this is done by sampling, handing out coupons and awareness events at high traffic areas ranging
from grocery stores, pet stores and other locations. This is work I have done before
for about six years until I was laid off but as a salaried employee not as an Independent Contractor. They sent you online to a site to put in your profile and
on Friday Jan 8,2011 I was called to let me know there was going to be a phone
conference on Sat, Jan 9, 2011 at 2pm with a lot of other people I was given an event number and a phone number to call this lasted about 30 minutes. On Sunday I was called and sent through my e-mail address about five papers to fill
out and return. I read the IC contract and then noticed they were telling me where to be and at what time and if I didn't show up or needed to cancel call this
number. they asked what age group I fell into had I ever been convicted of a felony? Was I ever convicted of a sex offense? They said the shift would be 6hrs
Friday, Saturday and Sunday. They wanted a head shot a voided check and were
going to send me a debit card to purchase whatever food item I would need to do
this demo but the appliances were on me gas and mileage was on me. The contract said all taxes were mine to deal with and that the company requires each
IC to provide a certificate of workman's compensation insurance in order to preform
assignments through the company. If a certificate is not on file, the company will deduct 3% from the per diem rate in order to cover the workman's compensation
Insurance. Also that I was responsible for providing any and all insurance necessary, including, but not limited to accident,Health and life Insurance.
Also states the undersigned hereby releases, discharges and agrees to save harmless, the company, its directors, officiers, representives, assignees, employees or any person or persons,or corporation,producingand/distributing products and any store at which the undersigned, including but not limited to,any physical impairment or loss to the undersigned or others. Neither the Company nor the undersigned
shall assume any liability whatsoever, each for the other, directly or indirectly.
As an IC the undersigned shall have exclusive control over the means, methods and details of completing any project obligation agrees to provide all tools and other supplies necessary to preform the details of any project, assumes all responsibility
for remitting to the appropiate taxing authorities and any and all taxes owed by the undersigned Federal,State,City and County taxes. The company assumes no
responsibility for any expenses of the undersigned, including but not limited to medical expenses incurred by the undersigned during or after the the term of any project. I feel this company whats it both ways as it suits their situation.
I was told by setting hours and days that this isan employee status not a Independent
Contractor and they state the pay is $54 dollars a demo shift of six hours.
