I hired Mike Habib to represent me in filing a $66,000 carry-back loss from 2009 to previous tax years. My expressed goal was to re-file past taxes, reducing those liabilities by $20,000, and using that to pay off some old IRS debt. Mike Habib agreed that this was an excellent idea, and demanded an advance retainer, which I paid. What Mike Habib didn't do was to pre-appraise my situation to advise me about the wisdom of a carry-back. He acted as if my tax situation was too complicated to analyze or comment on. I didn't think anything of it when I began with him around May, 2010. I assumed that if we had made a stupid choice, he would tell me. That was a mistake. Mike Habib is a foot-dragger. Once he had my down payment, he took months to file the carry-back. He insisted this was because of the complexity of the filing. This has also turned out to be false.
The IRS answered back with some surprising news: Mike Habib had ignored constraints on the maximum carry-back allowed for a given year, so they disallowed $8000 of my carry-back. This was because Mike Habib had no understanding whatsoever of the process, and had not spent any of his precious time reading the IRS rules.
Mike Habib had filed a carry-back to my tax year of 2005, even though I had no taxes due for that year. They disallowed this, and made other manual adjustments to correct his inept filing. The IRS told me that the carry-back would only affect my net income taxes due, and would not reduce major costs such as social security self-employment tax, penalties, and interest. The net benefit to me was just $6000. If carried forward to 2010, the benefit would be $22,000. If Mike Habib had spent one hour of his time reviewing the facts, he would have advised me to carry forward and not back. Mike said it was impossible to predict taxes because there were "too many factors". In truth, my taxes were simple and straight-forward, and could easily have been estimated. Mike Habib filed the carry-back for five years, claiming to me that this was "the required period" based on IRS rules. In fact, there is only a two-year carry-back requirement. So Mike lied directly to me when confronted with his foolishness. MIKE IS NOT A TAX PROFESSIONAL Mike also failed to file my California taxes, which means that I got stuck with two completely different sets of claims that disagreed with each other. He never warned me about state taxes, either. I have revoked Mike's filings with the IRS, but have been informed that because Mike spent so much time on this, I have probably lost my rights. Mike also failed to notify me that there is a filing deadline (10/15/2010) for revising, revoking, or carrying forward any loss. Mike disappears a lot. I had to threaten him to get him to answer either emails or phone calls. So our relationship was hostile. I am accustomed to dealing with actual adults when handling critical business matters. Mike withdrew from my case as soon as I began asking questions. He refused to discuss this matter with me, or to take corrective action. Mike Habib represents himself as a tax professional. Based on my experience, he is utterly incompetent and irresponsible. My only remaining remedy is to publish my experience to forewarn the general public about Mike Habib and My IRS Tax Relief.Net.
