On February 17th, I purchased a used 2007 Jeep Wrangler from Mark Kia. They were touting their impressive "100+ point checks" they do to ensure all vehicles are delivered without issues to their customers - they even factored, in the original sales price, a "fee" to supposedly cover the vast amount of work done to the vehicle - it was well over $1000. Again, they really tout their service department and the countless checks they do. Upon taking delivery, I noticed an oil leak the next day. It was leaking to the extend that there was oil on my driveway - a drip. It turns out, the drip was coming from the rear main seal. I brought this to their service department where they inspected the leak. The service department acknowledged the leak, but more poetically called it a "seep" - either way, call it what you want, oil is leaking from the vehicle. Later, the salesman explained to me that this particular issue doesn't represent an imminent safety issue, and since it is only a minor leak - or "seep" as they called it, they weren't obligated to repair it. They quoted me over $900 in repairs, but were willing to absorb $400 of that cost. First of all, I went to a reputable dealer in advance to get a quote for service - and they estimated far less than Mark Kia's estimate - so, they really weren't giving me anything. Second, I feel it is a reasonable expectation that the vehicle is delivered "leak free" and they should have fixed this issue no questions asked with zero cost to me. Again, they tout their "100+" point inspection - it should be reasonably assumed the vehicle is delivered issue free. Now if this issue would have manifested weeks later or hundreds of miles later, I would have accepted the "as-is" mentality and not pursued further. Perhaps from a purely legal standpoint, they are not obligated to fix this. However, you think about yourself in this situation -what would you reasonably expect?
