This is about a law firm in Omaha Nebraska trying to collect on a car that was reprocessed in 2002. Due to id fraud and id theft plus sickness back then, yes my car was reprocessed. I never heard one thing about this at all from the Ford Motor Company while i lived in Omaha up until October of 2007. I was never sent any information as to a judgment on this car at all from Ford. I received a letter from this Lee Law Office that they were going to get a Revival Judgment on this past due loan. First, they filed late according to Nebraska State law, that it has to be filed on before 90 days of when the judgment first ended of which was May 2005. They filed on this 1 year 3 months late according to Nebraska state law as explained on the internet. Somehow, they did get this judgment approved again in court and this is how i received this Final post judgment notification letter from them dated 6/01/11. In this letter to me, it says that i must contact them to avoid any post judgment enforcement efforts through the court. I did contact them over the internet to [email protected] within a 5 day period of this letter. The letter is very demanding to say the least - $8,276.23 is due them plus court cost and interest. 6 demands are listed in this paperwork to me. 1 - being ordered to appear in court and testify under oath concerning my assets 2- having the sheriff levy on my personal property and sell them at a public sale with proceeds going to the court for this judgment, 3- garnishment and any funds on deposit in any bank, 4- wage garnishment, 5- being held in contempt of court if i fail to appear in court and testify on my assets if served by the sheriff with an order to appear in court, 6- a lien on any real estate i own. Not bad for a bottom feeding law firm for wanting to collect on something that is this old. Had they done this in Omaha before 2005, they might have gotten something from me. I am now on a SS income and own very little in the way of anything at all. I rent an apartment, Have one car and very little in the bank to amount to a row of beans. It is not bad enough that i have gone through 9 years of bad credit already thanks to the listed problems above. But to have them send this type of a letter was the real low blow, for you can not get blood out of a person who has nothing. This type of collection is uncalled for and not needed to try and collect this long past due account. Money judgments expire every 5 years according to Nebraska State Law posted on the internet. How or if this applies in my case is unknown at this time. Beware of law firms like this. |
