I retained "Richard Koch" to defend my case against "Bank of America". The Million Dollar house they foreclosed upon was discovered to have a Swimming Pool, Pump House and Septic Tank on my property five years ago they offered me $175,000 to settle my "Encroachment Issue" I informed them that I would accept it if they secured my driveway easement and they refused. Fearing that I would be land locked. I would not be able to access my property. Their broker "Myrna Oakman" began to harass my wife and I and threatened to have us killed if we did not take their offer.Five years later they sued me and "Richard Koch" never appeared in court as promised nor did he update the courts or judge on my case. He refused to write a demand letter "Notice of Trespass". He lost a $175,000 case because he wanted to save me $225. Filing Fee. I gave him the police reports! I was offered $60,000 to settle my case and I refused because I have a Three Million Dollar House next door to my property. The attorney contacted the seller of the property and he thought that I helped him build a wall twelve years ago but he wasn't sure. I only helped him find the block layers. The land was already sub-divided by the county and it was still my land. Almost seven thousand square feet. "Richard Koch"went on nine vacations in nine months and he lost my case. He never informed me that I could have requested a "Arbitration Hearing" and I had to settle this case for $30,000. I was lied to from the beginning and Richard Koch does not no the meaning of the word "Promise". I refuse to pay him $5,000 for doing nothing but lying to me for nine months! |

My name is Richard Koch, and I am responding to the ridiculous claims made by Mr. Houser in his post. I have been practicing law for 35 years. I do good and conscientious work for my clients, they are happy with my services. Mr. Houser’s account is severely distorted and has little to do with reality. I didn’t “lose” Mr. Houser’s case and there were never any court hearings. There were intense negotiations which were made almost impossible because Mr. Houser did not tell me all the facts and because he kept changing his position.
Mr. Houser came to my office complaining that a neighbor’s fence and part of their pool were built on his property. He of course didn’t tell me that he had known about the property line all along and that he actually helped build the fence himself. I did not take a retainer because Mr. Houser told me was broke and I felt sorry for him. I spent many hours on his case in good faith, based on his promise to pay me for my time. After much negotiation I miraculously got him a settlement offer of $55, 000, which was far more than his claim was worth. I urged him to settle but he refused, and I withdrew from his case. Some months later the opposing attorney called and told me that he had discovered that Mr. Houser actually built the wall he was complaining about. The attorney reduced his offer to $30, 000. I relayed the offer to Mr. Houser, and he authorized me to accepted it. Then Mr. Houser changed his mind. I quit again, and Mr. Houser hired two other very competent lawyers, both of whom also quit in disgust. To this date Mr. Houser has never paid me one cent, nor has he paid either of the other two lawyers. Naturally he now claims that they scammed him too. The only one who committed a scam is Mr. Houser. |
