shamelessly withhold buyers' deposit and refused to return for no reason! |

Freshstart living ltd --- this famous bare faced is not new to British. For people who have been dealing with them all know their common tricks to cheat property buyers' money, and we are the victims of them.
in 2011 we planned to buy a property from this company, but they sold the same property to another people at the same time. Then we reasonably required the money back! However, 12 month passed, and we received nothing.
Freshstart lied to us that some people have already received cheque and they posted to us on 13th July 2012, but they couldn't even pride any evidence! According to our research and observation, only those people who took them to the court got the money back!!!
We have been experiencing calling them 5 days a weeks since last year, they have give hundreds of excuse to avoid to talk to us directly! at the end, the salespeople ignored our calls, and passed this case to 3 different people to handle! we couldn't find the right people to get the money back.
At the end, they asked their customer relation staff to placate us to delay to refund. This people(Nicholas) lied to us again and again, and even signed his name on a refund guarantee letter to confirm the date of issuing the cheque. However another month passed, this people started to give excuse to avoid to talk to us again, and consequently we haven't received any money from this company!

This building is not under management over few years!!! no security entry, no administration, poor car park, dirty internal environment! we can not even receive any mails over 12 months!!! And this company is still requiring management fees from owners without any management for a uncompleted project!!!
Freshstart asked me to delete my posts in other forums, but I will not stop disclosing the true nature of them until they return our money! |

Really dishonest and unethical company. My advice is to stay far far away. Perhaps even leave the planet earth.
I lost tens of thousands.
In my case; They have failed to deliver on selling property they categorically stated (in writing) they owned but DID NOT OWN (Victoria House, Milton Street, Nottingham - Check the land registry). Now, they are trying to keep my deposit money under the guise of signing a “non refundable” deposit.
They said they owned the property, conversion was almost complete and we would exchange contracts in a few weeks and complete before the end of LAST YEAR. It turned out that they NEVER even owned the property in the first place. They now expect to keep my deposit (and many others that I am in direct contact with) in case they might be able to purchase this property at some undefined point of time in the future. Totally unacceptable and unreasonable in the eyes of the law.
They obtained "deposit" money from me by MIS-REPRESENTING THE FACT THAT THEY OWNED THE BUILDING and REPRESENTED AN UNREALISTIC TIMESCALE FOR PURCHASE. I relied upon their representations prior to signing the purchase agreement. This was, in the opinion of my solicitor; either negligent or Fraudulent behaviour. You decide.
Now, after spectacularly failing to obtain the freehold to the property for over ONE YEAR and after ignoring most of our phone calls and emails they expect to keep our money?
Disgusting and outrageous behaviour. Not a reputable company at all.
They have acted despicably after their mistakes and refuse to pay us back the deposits that you owe us. |
