In February of 2011 I contacted Double L Transport (Louie Velasco) to haul a horse from Parker, CO to Scottsdale, AZ. On February 22nd I received a contract for shipping from Louie Velasco. On February 28th, 2011 I scanned and e-mailed a copy of the completed contract to Louie Velasco before putting it in the mail with two checks. Document attached. The hauling fee was $600. Per the contract, Louie Velasco required 50% at the time of booking and the balance due at the time of pick up of the horse being tranported. On February 28th, 2011 I scanned and e-mailed a copy of the completed contract to Louie Velasco before putting it in the mail. I mailed two checks with the contract, each for $300, totalling $600 (check numbers 105 and 108) One was to be cashed as the 50% down and one to be cashed upon pick-up. On March 1st (which was the original given pick up date but was later changed by Louie due to adverse weather; estimated "new" pick up was around March 5th), I contacted Louie Velasco via e-mail regarding a possibility of changing horses and dates to be shipped as the one I had planned to send may be getting sold at the last minute. I asked if I could apply the $300 down payment to the transport of another horse. He agreed that it would be fine. Hauling was postponed due to the potential buyer of my horse. Louie asked that I stay in touch about when I need to have a horse hauled. Documents attached. On March 8th, BOTH the 50% down check and the $300 check for the balance of the shipment were cashed. Images attached. I e-mailed Louie Velasco on March 9th asking him about why both checks were cashed and if I could get the balance refunded until we had a horse ready to be picked up. He never responded. Documents attached. In mid-April I began attempting to contact Louie Velasco to transport the original horse to Scottsdale as the sale did not go through. I called and left repeated messages several times each week, I sent e-mails, text messages, etc. which were never answered or replied to. Finally, when I called today (April 29th, 2011) he answered his phone. I told him that I was ready to ship my horse, and he told me that I owed him $400 if I wanted to ship my horse now because I forfeited the money I sent to him previously. I reminded him of our discussion regarding applying the $300 down payment towards a future transportation, and that since he cashed BOTH of my checks for the entire balance, that the transportation was already paid in full. He argued with me and began yelling at me over the phone. He denied everything. I told him I had everything in writing and he basically told me he was not going to do business with me and that he would not transport my horse. Nowhere on the contract does it state that ANY money paid towards a shipment would be non-refundable or forfeited.
