| We purchased a North Bay Hot Tub from Donald Berry, AKA "Arthog's Hot tub Sales on Ebay", on September 16, 2012, and he convinced us to pay using USPS money orders rather than Paypal, and gave us a discount if we did so. After several upgrades he talked us into, we are out $5,018.50, and NO hot tub to show for it. In November, 2012, he told us there was a problem with the hot tub not water testing properlt, and that an entire new hot tub would have to be built, and would take another 4 weeks. We never heard from him again, and when we tried to contact him with our 2nd request for a refund, he told us to contact his bancruptcy attorney, Mr. David Tilem, in CA. Oh, and to reference it's about a hot tub. Ebay won't help because they say the 45 days since we purchased the product is up, and therefore so is their so called consumer protection policy! I have been to war for my country, killed for my government, protected this great nation.....is that hard fought freedom for scum like Donald Berry? So he can continue to run his internet scams and get rich off the backs of others?? Be careful Mr. Berry.....you may rip off the wrong person. |

| We too have been scammed by this POS...he did the same number on us and our best friend, together we are out over 8 K. We know of a few others, in other states and in Canada. There are places you can go to report this POS, and from what we have learned he has done this before! Hopefully with sending money through the mail, the Post office can hit him the hardest with federal charges, as well as you state attorney general. We purchased a North Bay hot tub and a 10 X14 Gazebo from him as well. ($11, 000.00 order) He gave us the same story that I am reading from all the others. Finaly I told him I was comming out to his house in CA. to deal with it my way... With in two weeks time my Hot Tub & Gazebo was shipped to my house in Indiana. He helped me arrange the shipping and I finaly got my items. I was very happy with the quality. He told me 4 to 6 weeks when it all started and it ended up being 7 months. I guess I can call myself lucky, and him too because I was going to CA. to give him a visit!

Hello All DB Victims! How's that hot tub feel???
You are not alone! Regretfully, you (and me) are just a couple of the many victims of the theiving, POS, Donald Berry.
However, I'm not one to simply accept a $5 THOUSAND theft and blame myself. I have been to DB's house and found it in a state of disrepair. (And he doesn't even have a hot tub, even though his house is over 5500ft. elevation...)
After many attempts (voice mails and emails) to reclaim my $5k, DB referred me to his "attorney" - David Tilem - a "debt" relief agency! I'm not sure how giving DB $5k up front for a hot tub he didn't deliver is a "debt"??? He didn't "borrow" the money from me!
Anyway, I refuse to sit idly by (for years?) to wait on DB or the CA courts to "hopefully" do the right thing an return my $$$ to me!
Since this is clearly a case of felony interstate wire fraud, I filed a suit with DB's local police department...
I request that all of DB's victims contact Captain Ells and provide their evidence to support the case against DB. I want this POS in prison for decades for stealing our $$$!
