My company was buying from this company for a while. We had listed items on our website and auction sites. However our sales had recently increased quite a bit. We were contacted by a representative of the company called "Mark" who asked us to stop selling their products, as we were selling too cheap and because the products were ending up on auction sites. "Mark" also stated 'retailers' had complained about our pricing being too low. I advised that I thought asking us to do that may be against commercial law in this country in which the response was pretty much 'hysterical anger' "Mark" lost his temper completely and became furious despite the fact I had attempted to reach some sort of compromise to work with him to resolve the situation. After shouting for a bit he then hung up the phone. I later was on the phone with the owner 'Peter' he advised that our prices were 'unsustainable' and that they did not like the small size of our orders, I offered to make larger orders and store it in our warehouse, but that did not make any difference. In the end they decided to immediately cancel our account (as we were 3 days late on a bill). I asked if I could just send out the pending orders and ill just leave them next week. The owner replied to that "Well it's too late you should have thought of that before you mentioned the 'Commerce Commission', to which I replied "C'mon that's just vindictive" which Peter responded to by saying "Well im the owner I can do what I want!". Frustratingly I had to refund customers as I could not complete the orders as they would not even send orders we had already made days before. My whole opinion on this is it is infact price fixing and the very angry response I received is a case of "The lady doth protest too much" on my mentioning of New Zealand commercial Law. This company is running an illegal price fixing operation. I did contact the Commerce Commission and they advised me that it was likely "restrictive practices" but there was nothing they could do without more evidence. Unfortunately, "Peter" was reluctant to put his commentary on email, as he knows what he is doing is illegal and he is careful in making sure he gets away with it. If anyone else is on the bad end of pricefixing attempts from this company please make sure you inform the Commerce Commission and post something up here. I think if they get enough complaints they can do something about it.
