UPS holding claims money hostage until Pak-n-Ship store pays their bill. Internet, Maryland

Sold an expensive item on Ebay last fall. Took it to my local pak-n-ship store (Hub City Shippers in Hagerstown, MD) to have it professionally packed and shipped with insurance. The item arrived to the buyer damaged. A claim was filed with UPS by Hub City Shippers. After many months and numerous telephone conversations with various representatives of UPS and Jeff Paules, owner of Hub City Shippers who has lied consistently about his efforts and the problem with UPS, here is where we are on the claim 11 months later.


UPS acknowledges that they damaged the item and they have all the documentation to pay the claim. BUT, it seems Mr. Paules of Hub City Shippers owes UPS money. Despite Mr. Paules authorizing UPS to discuss the claim with me and to settle the claim directly with me, UPS is holding MY claims money hostage in the apparent hope that I will put pressure on Mr. Paules to pay the money he owes UPS so that I can finally receive compensation for the item that I owned and was damaged by UPS. Ironically, when the damaged item was originally returned to me, it incurred further damage at the hands of UPS. Because the independent pak-n-ship store in California had their UPS account paid up to date, I received that claims check 7 months ago. Still, UPS owes me an additional $2,250.00 on the original shipment claim which I apparently am not going to be able to collect until Hub City Shippers pays their bill.

You do realize that you are not a customer to UPS right? Hub City has a UPS account number they use and the bills are charged to that account. This is why all insurance claims are paid out to the shipper of the merchandise as default. It is because that's the only customer to the courier in the transaction.

Even though Hub City "authorized" UPS to pay out the claim to you doesn't change the fact that you are not their customer. A claim check would be sent to the shipper and you would be re-imbursed directly by that shipper. If they are in default with their UPS bill, they won't send an insurance claim since the account is not current.

Also, make sure you understand UPS policy when using the UPS store if you are under the impression they are not middlemen. They are franchised, and they are a division of the old chain "Mailboxes Etc". I mention that you should know policy because in the event of a claim they might try and get one over on you. I used to work for UPS so I know the policies. I sent a package UPS Next Day Air and it arrived late. I know for a fact that the service is guaranteed and UPS will refund me in full. I went to the UPS store to have them contact UPS (Because this was done on their account #). They tell me that the policy is to downgrade the package to 3 day select and I would be given back the difference. I know the policy so I demanded they call ups on speaker phone right there and say they want FULL credit for the late shipment. They gave me my full refund when it came from UPS. But they tried to rip me off, they are certainly middlemen.
