We are a group of Homeowners that live at Cottonwood Villas, a small community of Condos. Who have for many years been managed by a company called Colorado Management. Over the years it has been difficult dealing with the HOA fees that are staggeringly high. We have a very highly paid maintenance staff that does very little and most of the work is privately contracted out by the Management Company. The CEO of Colorado management is at most of our HOA meetings and conducts them which is wrong! They all have been friends for many years and this has become an issue and conflict of interest for the homeowners here. Last summer we got over 200 petitions asking them to leave and they ignored us. This past year they told us that we had to have our dryer vents, vented to the outside of the building and that they were charging each individual homeowner $900 and then $1000. They said that the city of Westminster said that we had to; no one got any official letters stating it! I called the city and they said that we had to and that it wasn't grandfathered even though the buildings are at least 40 yrs old! I was told by various contractors that this was not so! I got an attorney to investigate and they said that it was totally unnecessary and that there were less costly alternatives. The HOA has no right to force any construction inside of our units and cannot tell us what to do without a court order. Newt was trying to do this without our permission until we called him on it. State building codes would call for an upgrade only in cases of the condo becoming a rental unit or a complete remodel takes place. So after this event, the city came to a HOA meeting and told us that they couldn't make us do it. After all was said and done Newt continue to ask the homeowners to vote on it, after we told him that it was a individual decision, only 80 votes were collected. After this he put it in the monthly newsletter that the city was going to eventually do this and that it was going to cost each homeowner $3,000 a piece! I have my home up for sale and every Real Estate person that came to my house asked me about it. I believe that it is affecting the sale of our homes! Yesterday I got up in the attic of my building and to my amazement found that the dryer vents were a part of the original construction and was never connected. Mine was connected today and has been working perfectly fine. They also said that there was no way that the dryers could be vented to the outside without passing through a common wall at the cost of $1,000 per unit. We hooked mine up for $28.25 and we have all kinds of venting to the outside after we were told there was none. Now they are trying to raise again our already high fees, there are 430 units here with an average of $200 per month per unit. The board has it set up that we can only vote in officers once a year and any other time they decide who is on the board. It is one big mess. We want the management company investigated for unethical management of money. We don't have a lot of money for attorneys and our struggling now, can you please help us?
We need someone to represent us in a class action law suite, if you know of someone willing to do this please let us know! |
