I purchased my used vehicle at Cerritos Nissan on 10/7/10 from sales person Jimmy Zayas. In the financing department (all recorded) I made it clear that I was currently financing another car with Carmax. I was told financing had cleared & signed all my paperwork including the detailed sale contract.
A few days later, the head of financing (Ahmad Ali) called me asking personal questions in an extremely condescending tone. He would give me no information. I continually tried to contact the sales person (Jimmy Zayas), financing department (Eduardo) etc. They were rude on almost every occasion and continued to inform me that financing would go through and I just had to wait. The head of the finance department (Ahmad Ali) even hung up on me when I requested information.
I responded to an automated "follow up" email from Jimmy Zayas and complained to him about the situation. When Karen Tomasick (head of customer relations) "intercepted" the email, she called me, made false promises and did nothing to help. She merely told me to wait and that she would speak to Ahmad about his unprofessional conduct. She then sent me a thank you card saying, "enjoy your car!" They would not allow me to speak with the manager (Peter Fice). I was told I would hear from them but never did and kept getting the runaround. I called routinely and was told every time that everything was fine.
Finally, 38 days after my purchase, I got a call from Eduardo (that I missed - it took me 8 calls over 2 days to get in contact with him) telling me that there was good news. The car would be financed if i traded in my current (high end) car! Ridiculous. (He stated that car was the reason I could not be financed).
The sale contract clearly states that the Seller has the right to cancel the contract within 10 days of the contract with written notice. 38 days in my opinion is clearly a violation of the law and the contract. I was given false information the entire time and now they are trying to force me to return the car. |
