Cash Call has previously done several loans with me. No information about my mailing address or contact info had ever changed. Cash Call's customer service and billing department claim they sent the first two mortgage payment invoices to an address which was completely wrong bearing no resemblence to mine. They claim they called me, no calls received. Since this was a new loan, we were not alarmed, paperwork takes time...we figured Cash Call was busy or selling the loan. This property is owned by my Bro and me so, both of us thought Cash Call had mailed the invoice to the other brother. Fortunately we caught it about 60 ays after Cash Call's due date when I called in and immediately paid it via telephone. I was astounded that I was transferred to a aggressive female collections dept. employee who told me that she had put out a "Skip trace on me" and was intent on reporting this to the Credit Bureaus. I informed her that I had done many mortgage loans with Cash Call and that my address information, phone number, cell number, email etc. is and remained the same. She would have easy access to this as it is contained in several previous loans that they had done. Why not pull that info? She had no good answer. I stated to her that any negative reporting to Credit Bureaus would damage me and would likely be actionable. This did not impress her. She stated she would be reporting this. I then called the Customer Service Dept and was finally connected to a Mr. Virgil Grizzel who tooks some weeks to investigate this (why so long?). I followed up every 3 days or so waiting on his answer. Virgil came back and agreed that Cash Call had fouled this up and apparently inputted a wrong billing address. He could not explain to me why their collections dept. had not used the info on me in their files to pick up the phone and simply call me. When he started his internal investigation Virgil firmly stated he get this corrected. Several weeks later, he stated that while he agreed with me, his employer - Cash Call would do nothing about it! I indicated that I thought this to be blatent negligence, followed up by intention harm if they were to actually report this as two late mortgage, one 30 and one 60 overdue to the Credit Bureaus. They went ahead and did so after this warning. Cash Call had plenty of time to fix this before it hit my Credit records. They refused to do anything even though it was their wrongdoing. I am a part time real estate investor. This halted my ability to purchase another property or do any re-fi's at reasonalble rates. If there is a Real Estate Attorney with a winning track record who would like to take this on with out up front charges to me, there maybe several cases of this kind of this willful misconduct with other customers of Cash Call. |
