It has been one excuse after another from Carrie. We payed in full for the hardwood floors in January. She agreed to put the floors in her warehouse until we needed them (we are building a house). The following is a summary of the our attempts to get our hardwood: Actually a PARTIAL shipment is on the way with no eta on the rest. Why would I accept only a partial shipment. That right there is a breach of contract. The agreement we had was we would pay in full. You would keep in your warehouse until we were ready. We requested the wood on 4/17/2010 in an email. We didn't get a response back until we received an email on 4/27 from you saying that our wood got damage and you were trying to get a partial shipment out, but no time frame. The next communication we had with you was on 4/29 letting us know that we would be getting a partial shipment "mid next week". We sent you an email requesting status on 5/4. "Mid next week" has come and gone with no delivery. We sent you another email on 5/8 requesting you to call. On 5/9 you left a voice mail saying the partial shipment has been shipped and you would be getting us shipping information. We still have not received that. We sent you an email on 5/10 requesting a full refund. We will not accept a partial shipment as that was not part of the contract. Our contract was for you to be holding in your facility our full shipment until we were ready for it. We paid in full up front to make this happen. The time frame we discussed for pick up was April. The first indication in writing of or need date was in our email on 4/17. We have upheld our end of the contract. Do date we have not received our hardwood nor our full refund. You may want to talk to the Better Business Bureau about your F rating. This is her reply about the BBB.. As far as our rating with the BBB goes I do not worry about that because if you look at different "members" they have the same amount of complaints or issues and are "paid members" they have a A+ rating, if I wanted to blow $300 a month just to have them put a letter by my name I would. Why don't you Google the BBB conspiracy. Carrie said she would give us a full refund... here is what that means to her.. I agree to refund you the money, but it will not be received by the 8th I have to get the money back from the mill. So I can do money orders but it will be payments till I receive the money back. You may do what you need to but know I will not be responsible for any additional court fees since I have agreed to refund the money. And may I ask what it is you are going to file a police report for? This was a flooring purchase that was delayed by the mill, so I don't think the police will be to interested in a civil matter that we have agreed to resolve. And yes David I do have proof of the delay from the mill itself. We have talked to other people who are currently being scammed by Carrie Trujillo as well. Instead of their stuff being ruined in their warehouse (which they do not have a warehouse we found out) their hardwoods fell off of a truck. We could go on and on of their 'story' from Carrie as well. She is a professional scam artist and we want our money back from her IN FULL. If we accept anything other than the full payment this would put us in a bad situation per an attorney we met with. It would change the terms which is what she is hoping for. Then we won't have ANY chance of getting our money back. |
