Bay View Law Group Debt Pay Gateway Taking monthly payments but not paying anyone off Internet

I've been paying Bay View Law Group since April 2010. After I started paying them, I received over 1000 calls from creditors (I stoppedkeeping record of each call, time of call, etc.after 906). I was given a script to read to them and told to stop taking their calls. We were told to give them Bay Views contact phone number and to hang up. The number of calls made our life miserable for months! I even sent each creditor a letter with the information to call them and please stop harrassing us.


I've had letters fromlaw firms that I forwarded to them.


Last Friday (January 7), I had to pick up a registered letter (a Civil Summons) from our county court for GE Money Bank giving me 20 days to contact their lawyer. I had to fax that to the Bay View Law Firm Legal Department (1-949-478-8363) for them to "look over" the letter. Then on Monday, we got a letter Nauheisel Law Firm, PC, for HSBS Consumer Lending for over $14,515.73 and had a phone call on our answering machine from Avery Jackson at the law firm to contact him at 800-366-3510, ext. 309 to make arrangements.


After being told to forward all letters, etc. from the creditors or any lawyers and that we were not to talk with them, that Bay View Law Group would handle them, I don't know what to do.


When I call Bay View Law Group, I get the run around. I've never gotten anything from them showing that our payments are going to any creditor. I've been told it was on their website but it didn't show the last 3 payment we made (November, December, and January). I finally got hold of someone else today that told me I was looking on the wrong website and gave me another website to look on and still, it didn't show all our payments we made or where our money was going. It only showed that we have a $0 Savings Account Balance which makes me wonder if everything for 9 months has just gone to Bay View and tono creditors! If that's true, then no wonder the creditors are suing. I pay Bay View Law Group to pay the creditors!!!


What in the world am I to do? We've paid over $5,000 and now we have the fear that they are keeping all the money and not paying anything to keep the creditors and law firms off our backs.


Last weekend, I had chest pressure and high blood pressure from worrying about all this. Please help us.

Even now that the laws have changed, these debt settlement companies continue to burn consumers. In particular the ones that call themselves "law groups". Of course consumers need to accept some of the blame here as well. Think about it:
If a debt settlement company puts your creditors (or debt collectors) on notice (meaning they cant call you). What choice do they have other than file a law suit? They no longer have the ability to call you and ask you to pay it voluntarily.
If a debt company tells you that THEY will decide how much much of your debt you really have to pay how could that possibly be true? They aren't the people to whom you owe. Let me put it to you a different way: Pretend you are the lender. Somebody has signed a contract agreeing to pay you back $14, 000. Does some other unrelated 3rd party get to decide whether or not your borrow pays it all back? Of course not, that's ridiculous.
I'm constantly having this conversation with consumers and time and time again they choose to believe what is easier for them to hear.

However, Joe, that is not "exactly" what they are telling us. They are telling us that they LEGALLY work WITH the creditors to REDUCE the amount of debt. Sometimes to 40cents on the dollar. That is different than them telling us that "they" decide how much we will pay back. However, I like the person in the complaint have paid alot and seen "nothing" move.

Though some agent may tell someone like you who has hired them, Janero7, that they are "negotiating" a lower amount for you to pay, you yourself need to check out with the creditor if what the agent has told you is correct. The original contract was signed by you. It's up to you to make sure the agent has successfully gotten the creditor to tear up the original contract and to require you to pay less money. Otherwise, you can't know whether the original contract is in force or not. The second issue, then, is whether your agent is actually taking the money you're sending to pay the adjusted amount. You need to check with the original creditor to see if that's happening or not. If it's not, then you would be justified in thinking that you are being scammed.
So, in short, the obligation to make sure the original contract that you signed is either honored in full or changed and the new contract honored. For you - or others like you - to hand over those responsibilities to someone you don't even know just because they talk a good line is a sign that you need to learn to live your life in the real world rather than the fantasy world in which someone comes in to relieve you of your rightful responsibilities and to take care of you, making all of your problems "go away". I would suggest that, if you want help, go to Suze Orman's website - www.suzeorman.com - and click on "Resource Center" and then "Managing Debt." Start with "Paying off debt, " but then read and follow all the other advice she gives in that section of the site. Your creditors are not bad people you want to make go away; they are good people who gave you what you wanted and are now asking you to be responsible for upholding your end of the bargain. If you decide you're going to become responsible - as Suze Orman's advice will show you how to do - you will learn and grow from the experience and end up having a much happier and more successful life than you will by shirking your responsibilities and expecting someone else to bail you out. By the way, Janero7, I would suggest you put together as much evidence as you can regarding contact information for this Bay View Law Group as well as how much money you sent them and when you sent it, and once you have that put together, contact your own state's Attorney General and, if it's in another state, the Attorney General of the state in which Bay View Law Group has the address you were given for them. Attorneys General are responsible for pursuing those in their state who break the law; and you are probably not the only one who has been scammed by this outfit. Nothing may come of your doing this, but something might; and it is certain that you will get nothing if you don't at least try to enlist the aid of the authorities.
