Policy # A69017572PLA Claim# 72382236 On Oct 29,2010 I found out that the catalytic converter from my vehicle had been stolen and I reported to the proper authorities and contacted my insurance company as directed. On Friday October 29,2010 my vehicle was picked up by a tow truck supplied by Aviva insurance. On Tuesday Nov 2,2010 I was advised that my vehicle was ready for pickup. I went to 195 Midwest Rd in Scarborough Ontario. When I got there I paid the bill and was given the keys to my vehicle. As one of the employees from the shop brought my vehicle to the front where I was waiting I noticed that my vehicle was making the same noise but a not as loud as it was when I heard it without the catalytic converter. But it was noise that I did not hear before Oct 4,2010 the last time I had driven my vehicle. I asked the employee why was my vehicle still sounding almost as it did when my vehicle was brought into the shop. I received no reply. I walked back into the shops office and requested that the Manger be called cause I wished to speak to him. The Manger ( Tony ) came to the office to speak to me.


I told the Manger my concern and told him that my vehicle was not making or have any leaks to my muffler system what's so ever. I had the Manger bend down and inspect where the noise was coming from and he the Manger put his hand near the claps where the muffler is attached to the middle pipe and he told me that it was there where the leak and the noise coming from. He the Manger did not once said that there was any other leak. I even told him and he agreed that the muffler it self did not have any leaks. But when the appraiser was called in the following day and inspected my vehicle. He said that the muffler also had a leak and that was one of the source of the noise. How could the Manger inspect my vehicle in my presence and not find a leak to the muffler and then the following day the appraiser finds another leak that was not present on Tuesday Nov 2,2010. The Manger replied that I should speak to Mr Dale Bennett from the insurance company. I contacted Mr Dale Bennett and brought to his attention my concerns. On Wed Oct 3,2010 I was advised by another rep from Aviva insurance that they would be sending a appraiser to the shop. Now the appraiser was going to look at my vehicle for the first time, not only was the appraiser looking at my vehicle for the first time, but he was looking at my vehicle after the work had been done. Why was the appraiser not send to my house first before my vehicle was picked up? Why was the appaiser not called to the shop until I had complaint about the services and also after the shop had already put their hands on my vehicle? I am not saying that the shop did any of the damage to my vehicle. I am saying that the damage most of been done while the thief was yanking on my catalytic converter to remove it from my vehicle. Cause the noise coming out of my vehicle was not present on Oct 4,2010 the last time I drove my vehicle. This is outrageous that I file a claim in good faith and then get screwed even more by the same insurance company that I pay good money to propect me from this kind of actions.


I am very disappointment with the behaviour of Aviva insurane. I will say it again that the appraiser should of been dispatched to my home before my vehicle was picked up by anybody. Or the appraiser should of been dispatched to to the shop and inspect my vehicle before any work was approved. I do not know who signed off on the work to be done on my vehicle and I do not think that the protocol of the insurance company is to just sign off on any work to be done until the vehicle is inspected by appraiser first. I did not sign any documents regarding the repairs done to my vehicle. I did pay the bill cause I thought that the work had been done in a proper manner. Or I would not of payed the bill. If I knew that my vehicle was still having problems I would of delayed payment. But because I trusted my insurance to do the right repairs, I thought it was okay to pay the bill. By the time I received my vehicle from the shop it was to late for me to refuse payment, I had already made the payment. I was not given the chance to inspect my vehicle before making payment to the shop.


After I had payed the bill was when my vehicle was released to me. Also I would like to state that when I picked up my vehicle from 195 Midwest Rd I asked if my vehicle could be placed on the lifter so that I could look at the damage and also take pictures of it. I was told by ( Tony ) that I could not cause he was to busy. So why was I not allowed to photograph my vehicle before leaving the shop? Why was I refused even though Mr Tony knew that I had concerns regarding his services. I should of had the chance to take the photograph to make my case. But right from the get go things were not done in a proper manner and things could of been done more professionally. I would like to know why is this claim being recognized as a no fault accident when it was a theft of a catalytic converter. Also on November 8,2010 I had an appointment at my doctors office. I check my oil level and noticed that I needed to add oil to the motor. I went to the back of my vehicle to get the oil out of the container that holds all my gear for my vehicle. At about 10:30am I noticed that the container was not in my vehicle. I phoned the shop and advised them about what was missing out of my vehicle.


I received no reply from the shop and decided to call the police to file a report. the officer that took my report is officer with badge # 3094 and the report # is 3981146. I did not notice my hard plastic container missing cause I was more concerned regarding the service that I had received from Imperial Auto. The container was covered with a blanket that I use to hide my gear. I did try to have my son come over on October 29,2010 to help remove some of my stuff out of my vehicle before it was picked up by the shops towing. But my son was still at work and I couldn't get my items removed cause I am not able to pick up the item by myself cause of my disability. I have been disable since October 30,1997. I also noticed that my glove compartment was unlocked and it was locked when the tow truck picked up my vehicle on Oct 29,2010. There was nothing missing out of my glove compartment but I find it strange that it was unlocked. I never keep my glove compartment unlocked it's always locked. I do not understand why the shop would have to go into my glove compartment when they were only replacing a catalytic converter. I did not take notice of my items missing cause I was concerned about the shops services, so from the time I picked up my vehicle it did not cross my mind to check on my items that was in my vehicle.


I also would like to state that I will be bringing my vehicle to a in depended shop so that my vehicle could be inspected. Regarding the damage that my vehicle received when the catalytic converter was stolen. I have spoken to s supervisor and they refuse to do anything regarding my complaint Ms Carney stated that my claim as far as she is concerned is closed. Ms Carney also stated that the insurance is not responsible for the items that were stolen from my vehicle while it was that 195 Midwest Rd in Scarborough ONT and stated for me to call my property insurance. Why should I claim the theft on my property insurance when the theft occurred when my vehicle was at 195 Midwest Rd at Imperial Auto. I feel that I have tried to resolve this problem and I'm getting nowhere. I feel that this complaint should be investigated further. I just got off the phone with my insurance and the manger at Imperial Auto at 195 Midwest. Imperial Auto refused to give me any information regarding their property insurance so that I could file my loss. Today date is Thursday November 10,2010. I call Mr Tony the Manger from Imperial Auto at 195 Midwest Rd in Scarborough, Ontario Canada to ask for information regarding his property insurance regarding the theft of items stolen fro my vehicle while it was at his shop. He refused to give me such information and was very rude to me when I requested for the information. I was hanged up on by the Manger Tony and was not given the information that I require to file my loss of my items while my vehicle was in the position of 195 Midwest Rd in Scarborough, Ontario Canada. At Assured Imperial Auto. I would like my item replaced asap. Or I will have no choices but to file a small claims case at 45 Shepard Ave court. This man is rude a cheat and someone in his shop stole my storage case that contained personal items for my vehicle. Laura Smith from Aviva insurance refused to listen or have anything futher done with my concern. Joel Rocha
