Three years ago my wife and I, including our three children, bought a new home in" Kootenai Woods", a Homeowners Association in rural Bigfork, Montana. Shortly after moving in we noticed a truck spaying toxic pesticides along the roadway and in our front yard without permission. We discovered that the H.O.A. has been doing this for the last seven years now without writing a notification letter to the residence before they spray. By doing this they are putting people at risk of exposure to these deadly pesticides. I have asked them several times to write a pesticide notification letter to residence before they spray, they have refused to do so. They also are in direct violation of the H.O.A. rules and conveniences by doing this. The declaration of covenants specifically prohibits "unreasonably offensive or noxious activity" on the premises. This practice is creating a health hazard to homeowners and a potential for groundwater contamination. This ,in turn, will cause a reduction to our property value. Despite the viable option to brush cut for noxious weeds instead of using toxic pesticides; The H.O.A. will not adopt a safer alternative. This, after I've provided the H.O.A. with documentation of the potential harm to human health posed by the exposure to these pesticides. The president of the H.O.A. told me that he does not use toxic pesticides around his home or on his garden, yet he still advocates the use of toxic pesticides in our residential neighborhood. We now have to sell our house before my family gets sick from this or someone discovers the potential for groundwater contamination causing a depreciation to the property value. I didn't sign up for this, nor was I told upon purchasing our home that this is occurring. If you're wanting to go "Green" then don't do business here! |
