In response to the gentleman in Florida: MCPS/Woodforest National Bank say that that $495.00 charge for cancellation is per terms and conditions -- yet they cannot cite those terms and conditions. When I asked they pull the terms and conditions -- AFTER the FACt -- I received a three page agreement of terms that Woodforest National Bank did not even sign. The contract does not cite any such term as a $495.00 cancellation charge, nor does it refer the signator to the contract elsewhere for these terms and conditions. Most states require all terms and conditions up front. Without such terms and conditions, cited up front, there is no agreement. Not even for the monthly and annual fees in my contract. It is bank fraud. We should consult a class action attorney, because I think every account holder has the same contract.

I called last year well in advance of my 30 day notice with WoodForest only to be told it was a 2 year contract and I had another year before I could cancel. This was in July. So yesterday June 20, 2011 I called them to get the form i needed to cancel before my term auto renewed only to find out it was a 3 year term and that it renewed last year. I never received notice from the company that there was a renewal change and I am going to fight this. If anyone else had this happen and there is a class action suit, please let me know. |

i had faxed a cancelation notice to woodforest/mcps @ 281-465-2596 in jan 2011 and my contract was up
in july 2011 instead of cancelling my account in january and charging me the cancellation fee which had been raised without my knowledge from 375.00 to 495.00 (apparently they had to pass on the cost of the consumer lawsuit they lost in 08/09 for deceptive practices onto their processing dept). Upon calling them with the cancellation request i was advised by a mcps representative to run my contract out as the fees for the remaining time would be 335.65 instead of having to pay 495.00 up front all at once. this made sense except for when i called in july 2011 to verify that mcps would no longer be withdrawing money from my account and our business contract has ended i was told the contract had auto renewed and that i was suppose to inform them at least 30 days (key word at least 30days) prior to the contracts term. apperently the difference from january 11, 2011 to july 18, 2011 is less than 30days? when i asked to see a copy of the contract i was sent the first page which i had signed followed by 5 other dated 07/2011. i ve been doing some research to find out who the president of woodforest is to contact them directly and came up with nothing, i ve tried talking to multiple representatives @800-327-0093 but get no response other than "you owe us 495.00" when i ask why they say early termination fee. so i call with an attorney on the line and we get even less info than when i call alone (must be afraid they might say something incriminating especially with a professional on the line). Also whenever i bring up the fact that i sent a cancellation notice in january they respond with "we never got it" when i ask them to look back on january faxes they tell me that faxes are shredded every 30days so they cannot look back that far. when i tell them that i keep records that go back that far (i m a single retail store they are a big business) and that ican prove through my phone bill that the fax was sent on 1-11-2011 @12:42pm to 281-465-2596 the response is "we never received such notice". apperently they have a legal staff at mcps but no phone number only an email address [email protected] which i will be sending an email to see if the issue can be resolved but in the mean time mcps sends a 10 day collection demanding payment or else the amount will be sent to "collections, reported to the credit bureaus and or submitted to mcps attorney for legal action." so basically all things go the way they want even if this issue gets resolved i m still gonna have to straighten out my credit issue with the credit bureaus due to the incompetence of representatives employed by mcps. all i wanted them to do was cancel my account in january and charge me my fee but through trickery of mcps representative and the incompetence of the customer service, collections department, managers yes they are all the same in one since the # to reach any of those mentioned is the same 800-327-0093. if asked if i would be part of a class action suit my answer would be yes and not only for the aggravation and stress and numerous hours reviewing multiple conflicting contracts but the loss of business that i have incurred trying to settle this issue. |

I am in the exact same boat as the above complaints. Class action lawsuit should be filed!! I'm looking into it with my lawyer. |
