wamu - chase NOT APPROPRIATE SERVICE AND DELIVERATE INTENT TO FORECLOSE ON MY HOME jacksonville, Florida

Let's begin by saying that prior to my husband becoming unemployed we never missed a mortgage payment and have the bank payment history and bank statements to back this up. My husband loss his job around December of 2008 and began collecting unemployment benefits. Although extremely difficult we managed with the help of our kids to make the Mortgage payments on time every month. In February of 2009 while WAMU still held our Mortgage, we called and wrote to WAMU asking for help. We were told by the collections department, that the only way to get help was to default on our loan. We thought this was poor advise and wrote a letter to WAMU regarding this advice. We finally were contacted by WAMU and we were offered a Special Forbearence Agreement to provide temporary relief (letter dated 3/12/2009) by lowering our monthly mortgage payment to $500 per month. The letter stated and I quote if we made 3 payments of $500 per month 04/01, 05/01 and 06/01 which we did. Letter stated that if the 3 payments were made on time they would reevaluate our application and offer a payment workout solutions to bring account current (but we were never delinquent) prior to this. What they did not explain to us is that this $500 a month would cause me to be delinquent in my mortgage and in risk of foreclosure. After this the nightmare begins. We applied several times for the loan modification and finally approved and received a package to make the 3 trial payments in order to be modified for the Home Affordable Program offered by the government by the Obama Administration. We were so happy and made the 3 payments of $1311.32 on time! As a matter of fact the last payment was taken out twice, so we ended up making 4 payments instead of 3 according to the package received from Chase.


After we completed the trial period our modification never became official per Chase and we received letter of rejection due to excessive forbearance. Please remember that the excessive forbearance was caused by Chase. We continued making the $1311.32 for a few months and reapplied and denied over and over again for different reasons. We went back to making our original mortgage payment of $2414.92 and continue to do so as of now. Now we are being harassed by Chase on a daily basis telling us they will foreclosed unless we pay the delinquent amount of $24499.85 at once. On November 17th a letter dated by Chase Acceleration to Foreclose was sent. Why would a bank ask us to pay less money to help us and then try to take the only thing we have? All we ask now to please hold Chase to their promise to modify. Our delinquency was caused by Chase not us. Move this amount to the end of the loan. Why take our home?
